In response to an Information <br /> 1 Request from the court, Plaintiff filed its Amended Complaint on January 14, 2021. On that <br /> same day,the court served Defendant a copy of the Amended Complaint. The Notice of Filing <br /> 1 accompanying the Amended Complaint stated, "Defendant(s) in this case must respond in <br /> 1 <br /> I writing to the Complaint within 30 days of the date of this Notice. Tax Court Rule—Magistrate <br /> Division (TCR—MD) 2 A." <br /> i The court did not receive an answer or response from Defendant within 30 days serving <br /> ) <br /> the Amended Complaint. TCR—MD 7 G(1) states: <br /> "A motion for default may be filed when a defendant has failed to file an <br /> answer or a response. The court may notify all parties that defendant failed to file <br /> an answer or a response. The plaintiff may submit a motion for default asking <br /> that the relief requested in its complaint be granted. Once the motion <br /> ion IIf for <br /> the fault <br /> j is filed,the complaint cannot be amended unless the court appm <br /> defendant fails to file an answer or a response within 10 days of the filing of the <br /> motion for default,the court will consider the motion and may enter an order of <br /> default." <br /> ? On February 23, 2021, the court issued a letter to the parties, providing Plaintiff an <br /> 1 <br /> I <br /> opportunity to file a motion for default. The letter also stated that it is the responsibility of the <br /> I <br /> 1 <br /> ORDER TC-MD 210003N <br /> 1 <br /> 1 <br />
