<br />This survey was made to find
<br />or set monuments for the tract
<br />of land
<br />described in
<br />Reel 4422, Page
<br />39. That tract and all of those
<br />surrounding it
<br />are divided out of properties
<br />conveyed to Charles E. Andresen
<br />and Rose H.
<br />Andresen by
<br />deeds recorded in
<br />Volume 307, Page 104 and Volume 419, Page
<br />284. Being
<br />held by a common owner, the property then could
<br />be disposed of
<br />in any lawful
<br />configuration.
<br />The south line was set in its current location by Sales Agreement recorded in
<br />Volume 719, Page 390, dated March 24, 1971. That line was first surveyed
<br />by Clarence Barker on March 17, 1971 in a survey for C.E. Andresen. A
<br />map of barker's survey is filed as Survey No. 22001. Barker's survey
<br />matches the distances of the corresponding lines in the legal description.
<br />Therefore, I have accepted monuments from that survey and a subsequent
<br />Barker Survey, Survey No. 23311, for the line. Although the current deed
<br />overlaps this line as indicated in MCSR 37497, the tract described in
<br />Volume 719, Page 390 is senior and receives its full measure.
<br />Monuments for the east line were first set by Clarence Barker in a survey for
<br />C.E Andresen, which is dated February 5, 1973. Barker's survey is filed as
<br />Survey No. 23311. Barker's monuments are called for in Reel 68, Page 302.
<br />As indicated in MCSR 37497 by William Shenk, there is excess distance
<br />between this line and the old centerline of Lancaster Drive. Rather than leave
<br />a gap as was done by Shenk, it is my professional opinion that this area
<br />should be included with the land described in Reel 4422, Page 39. Because
<br />the goal of a land surveyor is to anticipate the view a court of competent
<br />jurisdiction would take in the presence of an ambiguity like this one, I rely on
<br />the following: In Nelson v. Vandemarr, 281 OR. 65, 573 (Or., 1978), the
<br />Supreme Court of Oregon (citing Hurd v. Burns, 264 Or. 591) applied the
<br />rule of construction regarding roads and streams found in ORS 93.310(4) to
<br />other strips of land by saying, "We have taken the view that where the
<br />conveyance or reservation of title to narrow strips of land is in question, the
<br />probable intent of the grantor is not to retain title if he does not own abutting
<br />land." Further, the Court said, "we have adopted a policy against construing
<br />conveyances to create 'strips of land the title to which would otherwise
<br />remain abeyance for long periods of time"'. Furthermore, looking at later
<br />acts of the grantor, it becomes clear that in the mind of the grantor, Barker's
<br />monumented line and the line described are one and the some. Evidence of
<br />this may be seen in Reel 620, Page 87 and all subsequent deeds, which say,
<br />"Beginning at a point which is 90 feet North 89'39' West from the
<br />intersection of the South line of Hayesville Drive and the East line of a tract
<br />of land conveyed to Charles E. Andresen and Rose H. Andresen, husband and
<br />wife, by deed recorded August 12, 1944, in Volume 307, Page 104, Marion
<br />County Deed Records; said point also being 90 feet North 89'39' West from
<br />the Northwest corner of a tract of land conveyed to Donald R. Satter". Only
<br />the latter part of this quote is true. Yet, it shows that in the mind of the
<br />grantor the two locations are the some. On the basis of the foregoing, I have
<br />accepted Barker's monuments.
<br />The tract described in Reel 2455, Page 429 is excepted from Reel 4422, Page
<br />39 and was not previously surveyed. I have set the corners for that tract
<br />based on deed distances along roads and from the two roads, with interior
<br />lines paralleling lines is indicated in the description. Two Barker monuments
<br />were used for the east line of Lancaster drive as shown. Two brass cap
<br />monuments were used for the centerline of Hayesville Drive and offsets from
<br />the description of a pending Marion County Permanent Right -of -Way
<br />Easement description were used for the south line of Hayesville Drive.
