<br />NARRATIVE
<br />This survey was made to place monuments for the south line of the tract of
<br />land described in Reel 4124, Page 182 of the Marion County Deed Records.
<br />The description refers to the fractional parts of the section. Therefore, it is
<br />first necessary to locate the boundaries of the northwest quarter of the
<br />section.
<br />At the section corner and quarter corner monuments set based on original
<br />evidence and/or County monuments legitimized by ORS 209 are found.
<br />Within the section there have been differing opinions about how to subdivide
<br />the section. Fisher's subdivision was first and should be honored as the
<br />original division. Most surveyors have adopted this approach. In survey No.
<br />16176, Ralph Barnes subdivided the section anew. In that survey he set the
<br />center northwest sixteenth corner for the first time. Although other surveyors
<br />and I reject his approach along the north—south center of section line, the pipe
<br />he set at the center north sixteenth corner is the first instance of that corner
<br />being monumented. Property owners have long since adopted it as is
<br />evidenced by the old fence corner there. Therefore, it is appropriate to use
<br />Barnes monument.
<br />The tract of land described in Reel 4124, Page 182 and many that adjoin it
<br />are described with cardinal bearings and distances in rods. The south
<br />adjoining property is described as a fractional part. Taken with wooden
<br />literalism, the descriptions using rods would leave gaps and overlaps at
<br />virtually every boundary. This perceived lack of harmony is a latent
<br />ambiguity, which allows one to consider other factors. Because the
<br />descriptions are written using rods, it is likely that they were written by
<br />someone more familiar with farming than with proper method of description.
<br />It is appropriate to bear in mind the experience level of the scrivener when
<br />construing descriptions. Although this section was never a perfect 80 chains
<br />by 80 chains, the perception of the uninformed is that all sections are regular
<br />sections. If that view is taken and the description in rods are viewed within
<br />the framework of the Public Land Survey system, applying proportionate
<br />measure, all of the properties are harmonized. There are no overlaps, and no
<br />gaps are left, which might otherwise lead to vexatious litigation.
