<br />'mss �o [RINGNALDA, 37241] I This survey was made to find monuments or remonument corners or lines of the tracts of land described in Reel
<br />s 2403, Pae 143, Reel 2403, Pae 143, Reel 3565,
<br />of I 9 g Page 466, and Reel 4300, Page 468. The first three are based on
<br />Survey Nos. 16138, 16550, and 16862 by Paul Ferguson. The fourth tract is based indirectly on the Ferguson
<br />I surveys in that it is based on a west—adjoining tract for its location.
<br />I The Little North Santiam River is called for as the north line of these tracts of land. I have neither located nor
<br />1 addressed that line. The location of the river is plotted from an aerial photo that is not known to have been
<br />I orthorectified.

<br />I N While it may seem a simple matter to retrace a former survey, surveyors (myself included) have struggled with this
<br />1 °W_ particular set of surveys. In the best of circumstances for this area, locating existing corner monuments is
<br />complicated by iron in the rocks such that magnetic locators do not work well. Along the river, monuments are
<br />I cn sometimes buried in the alluvial sediment.

<br />I ;°0 It was well known among the surveyors who mentored me that Paul Ferguson was predisposed to errors, even
<br />3 i blunders, especially in calculations. This group of surveys is no exception. The error or errors were perhaps
<br />I �,_ discovered by Ferguson or whoever wrote the original descriptions for the common line between Lind and Cowan.
<br />1 ; The bearing of the line as monumented does not match Ferguson's reported bearing but does match very closely
<br />I N� with the actual bearing. A 1966 survey by Howard Taylor was one of the first to clearly indicate a bearing problem
<br />zPO and monument placement problem at the line between Sections 2 and 11. My measurements indicate a discrepancy
<br />.�. OF TyF 1 3 of over two degrees there. At the line between Lind and Cowen, the discrepancy is nearer to three degrees. These
<br />O�Q �FUL TO I N errors further complicate the search for monuments from the original surveys.

<br />oI Where there is a known error, the principle to be applied is to "place the error where the error occurred". In this
<br />E 1/16 S2 X case, some of Ferguson's monuments are now missing. The goal is to "follow the footprints" of the original survey
<br />GS11 i— I and place them where they originally existed, not merely where measurement from one direction or another may
<br />Ln 1994 ��= 1 place them. To do that, it is most important to understand procedures followed and instruments used by surveyors of
<br />pib Gtr, I the time. At the time of Ferguson's surveys, transit and steel tape would have been used. Because there is a steep

<br />�P I escarpment along the riverbank, it is implausible that the side lines of these parcels were actually run. Instead, the
<br />D M south lines and the line along the river would have been run independently and the side lines calculated. The
<br />EAST 16TH CORNER I difference in bearing at the Cowan/ Lind line and the monumented line at 50—foot offset provide evidence that this
<br />3 1/4" BRASS DISK I was the case. The error or errors in Ferguson's surveys seem to have been primarily, bearing or angular errors; his
<br />N8919.63 "W 1295.77' OR 19.633 CHAINS [TUERS, OR-RO66 PAGE 21] distances check reasonably well. Therefore, it is most reasonable to

<br />measurements from the nearest upstream monument. If this is done, the locations fall in the steep escarpment where
<br />it is unlikely Ferguson would have placed monuments. The side lines of the Cowan, Lind, and Frith properties were
<br />located and marked based on a retracement of Ferguson Is survey according to knowledge of the way it would have

<br />The Gorsuch property is not known to have been surveyed originally. There is just one physical monument (other

<br />than the river) that is called for and it was set in one of the three Ferguson surveys of the three tracts to the west.
