THIS SURVEY WAS PREPARED FOR CITY OF SALEM. <br />OF O.R.S. <br />PAGE 178) <br />MCSR 8807, MSCR 16285 AND MCSR 18240. IN PARTICULAR, THE POINT <br />WHERE THE CENTERLINE <br />OF HILFlKER <br />THE WEST RIGHT-OF-WAY LINE OF <br />SUNNYSIDE ROAD SE PER REEL 1237 PAGE 178 WAS THEN LOCATED PARALLEL WITH AND A <br />THIS SURVEY RESOLVES THE EXISTING CENTERLINES AND RIGHT-OF-WAY LINES ALONG <br />THE PROJECT CORRIDOR AND <br />CALCULATED 31.00 FEET WESTERLY <br />WHEN MEASURED AT RIGHT ANGLES TO THE ABOVE-DESCRIBED CENTERLINE. THIS WAS DETERMINED <br />ALSO ESTABLISHES A SURVEY CONTROL NETWORK. <br />PREVIOUSLY DESCRIBED <br />BY COMPARING THE CURVE RADIUS <br />OF THE SAID CENTERLINE WITH THE WEST RIGHT-OF-WAY LINE PER SAID REEL 1237 PAGE 178. <br />BASIS OF BEARINGS AND HORIZONTAL CONTROL DATUM <br />THE HORIZONTAL COORDINATES SHOWN ON THIS SURVEY ARE LOCAL DATUM PLANE GROUND COORDINATES, AND ARE <br />REFERENCED TO N AD83(201 1 )(EPOCH 2010.00), OREGON COORDINATE REFERENCE SYSTEM (OCRS), SALEM ZONE, WITH <br />DISTANCES MEASURED IN INTERNATIONAL FEET. OCRS SALEM ZONE COORDINATES WERE ESTABLISHED FOR CONTROL <br />POINTS 1, 2, AND 3 UTILIZING GPS METHODS TO ESTABLISH A PROJECT BASELINE. ALL REDUNDANT GPS VECTORS <br />WERE LEAST SQUARES ADJUSTED TO THE 959 CONFIDENCE INTERVAL. <br />TERRESTRIAL SURVEY METHODS WERE THEN USED TO COMPLETE A PROJECT TRAVERSE AND CONTROL TIES. A LEAST <br />SQUARES ADJUSTMENT WAS THEN COMPLETED TO THE 959 CONFIDENCE INTERVAL TO ADJUST ALL TERRESTRIAL <br />SURVEY TIES, HOLDING THE OCRS SALEM ZONE COORDINATES FOR CONTROL POINTS 1, 2, AND 3 FIXED. <br />FOR THE PURPOSES OF THIS SURVEY, THE BASIS OF BEARINGS IS N08 -17'33"E, AS MEASURED ALONG THE CENTERLINE <br />OF SUNNYSIDE ROAD SE, BETWEEN FOUND MONUMENTS 54 AND 55. <br />VERTICAL CONTROL DATUM <br />THE ELEVATION DATUM FOR THIS SURVEY IS CITY OF SALEM (NGVD29-47) BASED UPON CITY BENCHMARK 8300, <br />ELEVATION = 406.76 FEET. A CLOSED DIGITAL LEVEL LOOP WAS COMPLETED UTILIZING SAID BENCHMARK AND <br />CONTROL POINTS 1-3. A LEAST SQUARES ADJUSTMENT TO THE 95% CONFIDENCE INTERVAL WAS COMPLETED FOR THE <br />LEVEL LOOP. SEE SURVEY CONTROL TABLE FOR RESULTING ELEVATIONS FOR CONTROL POINTS 1-3. <br />ROADWAY LOCATIONS <br />SUNNYSIDE ROAD SE CENTERLINE (PER MCSR 33954) <br />THE CENTERLINE OF SUNNYSIDE ROAD SE PER MCSR 33954 WAS LOCATED BY HOLDING FOUND MONUMENTS 51, 52, 53, <br />54, AND 55, TOGETHER WITH RECORD DATA PER SAID SURVEY AS SHOWN. THE STATIONING SHOWN FOR SUNNNYSIDE <br />ROAD SE IS PER MCSR 33954. <br />SUNNYSIDE ROAD SE (COUNTY ROAD 837) <br />THE CENTERLINE OF COUNTY ROAD 837 (60' WIDE) CANNOT BE ACCURATELY LOCATED DUE TO A LACK OF ORIGINAL <br />MONUMENTS. MCSR 4249, COMMISSIONERS COURT JOURNAL 21 PAGES 480-482, AND THE NOTES FOR ROAD BOOK <br />ENTRY NO. 459 (ROAD BOOK 5 PAGES 377-378) INDICATE THE PRESENCE OF IRON PIPES LOCATED AT 1 MILE <br />INTERVALS ALONG THE CENTERLINE. THESE MONUMENTS WERE NOT RECOVERED BY MCSR 33950, MCSR 33954, MCSR <br />34485, MCSR 35260, MCSR 36902, ODOT HIGHWAY MAPS, OR ANY OTHER AVAILABLE SURVEYS. THIS SURVEYOR <br />ACCEPTS THAT THESE PREVIOUS SURVEYS DID THEIR DUE DILIGENCE AND THESE MONUMENTS NO LONGER EXIST. <br />FURTHERMORE, THIS SURVEYOR ACKNOWLEDGES THAT ANY ATTEMPT TO RESOLVE THE LOCATION OF THE ORIGINAL <br />CENTERLINE AND RIGHT-OF-WAY LINES OF COUNTY ROAD 837 WOULD NOT FIT WITH THE EXISTING IMPROVEMENTS AND <br />OCCUPATION. THEREFORE ACCEPTED RIGHT-OF-WAY LINES HAVE BEEN LOCATED AS DESCRIBED BELOW. <br />IT SHOULD BE NOTED THAT A PORTION OF SUNNYSIDE ROAD SE (COUNTY ROAD 837) IN SECTIONS 23 AND 26, <br />TOWNSHIP 8 SOUTH, RANGE 3 WEST, WERE LEGALIZED AS SHOWN ON MCSR 36902. <br />SUNNYSIDE ROAD SE (ACCEPTED EAST RIGHT-OF-WAY - NORTH OF HILFlKER LANE SE) <br />THE ACCEPTED EAST RIGHT-OF-WAY LINE OF SUNNYSIDE ROAD SE WAS LOCATED BY HOLDING POINT "A" AND FOUND <br />MONUMENT 75. POINT "A" IS THE CALCULATED LOCATION OF FOUND MONUMENT 21 SHOWN ON MCSR 33954 AND SET <br />BY MCSR 29277. THE ORIGIN OF FOUND MONUMENT 75 IS UNKNOWN, BUT WAS FOUND BY MCSR 15742. THIS <br />SOLUTION FIT POINT "B" FOR 0.08'. POINT "B" IS THE CALCULATED LOCATION OF FOUND MONUMENT 20 SHOWN ON <br />MCSR 33954 AND SET BY MCSR 24502. <br />SAID ACCEPTED EAST RIGHT-OF-WAY LINE WAS EXTENDED SOUTHERLY A RECORD DISTANCE PER MCSR 29277 TO <br />POINT "C" AS SHOWN. POINT "C" IS THE CALCULATED LOCATION OF A PK NAIL SET BY MCSR 29277, BASED ON <br />RECORD DATA FROM MCSR 24502. MCSR 24502 FOUND AN IRON PIPE AT THIS LOCATION AS SHOWN ON MCSR 8807, <br />MCSR 15742, MCSR 16285, AND MCSR 18240. CALCULATED POINT "C" MATCHES THE RECORD DISTANCE PER MCSR <br />24502 FROM THE CALCULATED 1X4 CORNER BETWEEN SECTIONS 10 AND 11 AS SHOWN FOR 0.02'. CALCULATED POINT <br />"C" ALSO MATCHES THE RECORD DISTANCE FROM FOUND MONUMENT 75 PER MCSR 15742 FOR 0.01' <br />SUNNYSIDE ROAD SE (ACCEPTED EAST RIGHT-OF-WAY - SOUTH OF HILFlKER LANE SE) <br />THE ACCEPTED EAST RIGHT-OF-WAY LINE OF SUNNYSIDE ROAD SE WAS LOCATED BASED UPON MCSR 18240. FROM <br />CALCULATED POINT "C" DESCRIBED ABOVE, A CALCULATED RECORD DISTANCE OF 33.00 FEET WEST ALONG THE <br />CENTERLINE OF HILFlKER LANE SE (DESCRIBED LATER IN THIS NARRATIVE) PER MCSR 18240, MCSR 16285, AND MCSR <br />8807 WAS HELD TO LOCATE THE INTERSECTION OF THE CENTERLINE OF HILFlKER LANE SE AND THE CENTERLINE OF <br />SUNNYSIDE ROAD -SE PER SAID MCSR 18240. THE CENTERLINE OF SUNNYSIDE ROAD SE PER MCSR 18240 WAS THEN <br />LOCATED BY HOLDING THE ABOVE-DESCRIBED INTERSECTION AND A POINT 30.00 FEET WESTERLY WHEN MEASURED AT <br />RIGHT ANGLES TO POINT "E". POINT "E" IS THE CALCULATED LOCATION OF FOUND MONUMENT 34 SHOWN ON MCSR <br />33954 AND SET BY MCSR 18240. THE ACCEPTED EAST RIGHT-OF-WAY LINE OF SUNNYSIDE ROAD SE WAS LOCATED <br />PARALLEL WITH AND 30.00 FEET EASTERLY WHEN MEASURED AT RIGHT ANGLES TO THE SAID CENTERLINE PER MCSR <br />18240. <br />SUNNYSIDE ROAD SE (ACCEPTED WEST RIGHT-OF-WAY - PRINGLE CREEK PARK ADDITION) <br />THE ACCEPTED WEST RIGHT-OF-WAY LINE OF SUNNYSIDE ROAD SE WAS LOCATED BY HOLDING POINT "D" AND FOUND <br />MONUMENT 57. POINT "D" IS THE CALCULATED LOCATION OF FOUND MONUMENT 91 SHOWN ON MCSR 33954 AND SET <br />BY THE PLAT OF "PRINGLE CREEK PARK ADDITION FOUND MONUMENT 57 WAS SET BY "PRINGLE CREEK PARK <br />ADDITION". <br />MCSR 39483 <br />THE WEST RIGHT-OF-WAY LINE OF SUNNYSIDE ROAD SE PER RESOLUTION NO. 98-162 (SEE ALSO REEL 1226 PAGE 183) WAS LOCATED <br />PARALLEL WITH AND 31.00 FEET WESTERLY WHEN MEASURED AT RIGHT ANGLES TO THE ABOVE-DESCRIBED CENTERLINE. <br />A REVIEW WAS COMPLETED OF SAID REEL 1237 PAGE 178, SAID REEL 1226 PAGE 183, AND REEL 1213 PAGE 81 (SOUTH OF THIS AREA), <br />TOGETHER WITH MCSR 33954 AND MCSR 34325. UPON PRELIMINARY REVIEW OF THE DESCRIPTIONS IT WOULD APPEAR THAT THE <br />RIGHT-OF-WAY IN THIS AREA WOULD HAVE BEEN 7.00 FEET WESTERLY OF THE ORIGINAL RIGHT-OF-WAY OF SUNNYSIDE ROAD SE <br />(COUNTY ROAD 837). HOWEVER, THE BEARINGS ON REEL 1226 PAGE 183 AND REEL 1213 PAGE 81 MATCH THOSE OF THE MONUMENTED <br />CENTERLINE PER MCSR 33954, NOT THE SAID ORIGINAL CENTER SHOWN ON SAID SURVEY. IN ADDITION, THE CURVE RADIUS MATCHES A <br />31.00 FOOT OFFSET FROM THE MONUMENTED CENTERLINE PER MCSR 33954. 1 THEREFORE CONCLUDED THAT THE INTENT WAS FOR THE <br />WEST RIGHT-OF-WAY TO BE PARALLEL WITH AND 31.00 WESTERLY WHEN MEASURED AT RIGHT ANGLES TO THE SAID MONUMENTED <br />CENTERLINE. THIS IS CONSISTENT WITH MCSR 34325 AND MATCHES THE EXISTING ROADWAY IMPROVEMENTS IN THIS AREA. <br />HILFlKER LANE SE (CENTERLINE) <br />THE CENTERLINE OF HILFKER LANE SE WAS LOCATED BY HOLDING THE ABOVE-DESCRIBED POINT "C" AND FOUND MONUMENT 101 PER <br />MCSR 39415. THIS SOLUTION IS CONSISTENT WITH MCSR 8807, MCSR 15742, MSCR 16285, MCSR 18240, MCSR 24502, AND MCSR 29277. <br />THIS SOLUTION ALSO MATCHES THE RECORD 30.00 FOOT OFFSET FROM FOUND MONUMENT 74 PER THE PLAT OF "WILDRIDGE". THE <br />STATIONING SHOWN FOR HILFlKER LANE SE IS PER THIS SURVEY. NOTE THAT FOUND MONUMENT 53 APPEARS TO HAVE BEEN SET ON A <br />CONSTRUCTION/PROJECT ALIGNMENT LOCATION AND WAS NOT HELD FOR THE CENTERLINE OF HILFlKER LANE SE. <br />HILFlKER LANE SE (VOLUME 202 PAGES 276-277 AND GATEWAY ROAD) <br />AN EXCEPTION FOR A ROADWAY FIRST APPEARED IN VOLUME 202 PAGE 276-277 IN MAY 8TH OF 1929. THIS EXCEPTION WAS FOR A <br />15.00 FOOT WIDE ROAD LYING ON THE NORTHERLY SIDE OF THE SOUTH LINE OF THE NORTHEAST ONE-QUARTER OF SECTION 10 BETWEEN <br />THE ONE-QUARTER CORNER COMMON TO SECTIONS 10 AND 11, AND THE EAST SIDE OF THE COUNTY ROAD LEADING FROM SALEM TO <br />JEFFERSON (COUNTY ROAD 837). THERE DOES NOT APPEAR TO BE A FORMAL DEDICATION FOR THIS 15.00 FOOT WIDE STRIP, HOWEVER <br />DUE TO THE PRESENCE OF THE EXISTING ROADWAY AND SUBSEQUENT DEDICATIONS, IT IS BELIEVED THAT A COMMON LAW DEDICATION <br />WAS FORMALLY OR IMPLIEDLY ACCEPTED BY THE CITY OR COUNTY. <br />A REVIEW WAS ALSO COMPLETED OF MARION COUNTY CLERK FILE NO. CF0968 FOR A GATEWAY ROAD ALONG HILFlKER LANE SE BETWEEN <br />THE ONE-QUARTER SECTION CORNER COMMON TO SECTIONS 10 AND 11, AND THE EAST SIDE OF THE PACIFIC HIGHWAY (COMMERCIAL <br />STREET SE). IT IS UNCLEAR IF THIS GATEWAY ROAD WAS FORMALLY ACCEPTED AS DEPICTED ON MCSR 12290 AS NO FINAL ORDER <br />APPEARS TO BE LOCATED IN THE FILE. IN PARTICULAR, THE POINT <br />WHERE THE CENTERLINE <br />OF HILFlKER <br />LANE SE INTERSECTS THE CENTERLINE OF SUNNYSIDE ROAD <br />SE (AS SHOWN ON SAID SURVEYS) <br />IS 33.00' WESTERLY OF THE ABOVE <br />DESCRIBED POINT "C". <br />BY LOCATING THE ACCEPTED EAST RIGHT-OF-WAY OF SUNNYSIDE ROAD <br />SE (SOUTH OF HILFlKER <br />LANE SE) AS <br />PREVIOUSLY DESCRIBED <br />IN THIS NARRATIVE, THIS SOLUTION <br />YIELDED A MEASURED DISTANCE OF <br />161.03' (RECORD 161.11') <br />ALONG THE <br />CENTERLINE OF HILFlKER LANE SE AS SHOWN ON SHEET 3. <br />THE SOUTH RIGHT-OF-WAY LINE OF HILFlKER LANE SE PER SAID REEL 257 PAGE 1371 WAS LOCATED PARALLEL WITH AND 33.00 FEET <br />SOUTHERLY WHEN MEASURED AT RIGHT ANGLES TO SAID CENTERLINE AS CALCULATED PER SAID DEED. RECORD DEED DISTANCES ALONG <br />THE WEST RIGHT-OF-WAY LINE OF COMMERCIAL STREET SE (38.83') AND THE EAST RIGHT-OF-WAY OF SUNNYSIDE ROAD SE (42.32') <br />WERE THEN HELD TO LOCATE THE ANGLE POINTS OF SAID DEED. FROM THESE POINTS, RECORD DEED DISTANCES WERE HELD TO <br />INTERSECT THE SAID SOUTH RIGHT-OF-WAY AS SHOWN. <br />THERE ARE SIGNIFICANT DIMENSION ISSUES SHOWN ON MCSR 29277 THAT HAS CREATED CONFUSION ABOUT HOW TO LOCATE THE <br />RIGHT-OF-WAY DEDICATION PER REEL 257 PAGE 1371. THIS SURVEY HOPES TO RESOLVE THAT CONFUSION. <br />HILFIKER LANE SE (NORTH RIGHT-OF-WAY PER REEL 269 PAGE 1016) <br />A REVIEW OF REEL 269 PAGE 1016 INDICATED THAT THE DEED CONTAINED CLOSURE ISSUES WHICH WERE PERPETUATED BY MCSR 29277. <br />A REVIEW OF THE DEED ALSO INDICATES THAT IT APPEARS TO HAVE BEEN BASED UPON MCSR 24502.
