(ODOT KEY NO. 18745). THE <br />PROJECT IS ALONG THE SILVER CREEK FALLS HIGHWAY 163 (OR 214 - WATER STREET) FROM MILEPOST 39.73 TO <br />MILEPOST 40.11 (STATIONS 100+00 THROUGH 120+00). UNLESS OTHERWISE NOTED, INTERSECTING <br />STREET R/W AND PRIVATE PROPERTY BOUNDARIES WERE NOT RETRACED AS A PART OF THIS SURVEY. <br />PROJECT CONTROL <br />THE HORIZONTAL CONTROL NETWORK DATA FOR THIS SURVEY WAS COLLECTED AND PROCESSED IN MAY OF <br />2017. MEASUREMENTS INCLUDE A COMBINATION OF STATIC GNSS DATA, REAL-TIME KINEMATIC (RTK) GNSS <br />DATA, AND CONVENTIONAL TERRESTRIAL OBSERVATIONS. COORDINATES ARE PROJECTED TO THE OREGON <br />COORDINATE REFERENCE SYSTEM (OCRS) - SALEM ZONE AS REFERENCED IN OAR 734-005. HORIZONTAL DATUM <br />IS NAD 83 (201 1) EPOCH 2010.00. FOR PRIMARY NETWORK CONTROL, GNSS AND TERRESTRIAL OBSERVATIONS <br />WERE ADJUSTED SIMULTANEOUSLY USING MICROSURVEY STARNET PRO VERSION 8. THE NETWORK WAS <br />CONSTRAINED TO THE OREGON REAL-TIME GNSS NETWORK (ORGN) STATIONS ODOT (ODOT TLC BUILDING <br />SALEM), P412 (MULINO), STAY (STAYTON), WDBN (WOODBURN) AND MCSO (SALEM MARION COUNTY) WITH 95% <br />CONFIDENCE LEVEL UTILIZING THE CHI SQUARE TEST. <br />BASIS OF BEARING FOR THIS SURVEY ARE DEFINED BY NETWORK POINTS 1 & 2 WITH A BEARING FROM POINT 1 <br />TO POINT 2 OF SOUTH 40°18'59" EAST AND A DISTANCE OF 6,196.17 FEET. <br />ALL MEASUREMENTS DEPICTED ON THE FACE OF THIS SURVEY ARE REPORTED IN INTERNATIONAL FEET UNLESS <br />OTHERWISE NOTED. <br />MONUMENT RECOVERY <br />INITIALLY, THE SCOPE OF THIS PROJECT SPANNED FROM SMITH ST TO PIONEER DRIVE AND INCLUDED <br />RECONSTRUCTION OF OR214. DUE TO BUDGET CONSTRAINTS, THE PROJECT WAS RESCOPED WITH PLANNED <br />CONSTRUCTION ACTIVITIES TO INCLUDE GRADING, DRAINAGE, PAVING, CURB RAMPS, SIGNING, AND ROADSIDE <br />DEVELOPMENT ALONG THE NORTHEAST SIDE OF THE SILVER CREEK FALLS HIGHWAY 163 FROM JOHNA LANE TO <br />FENNE LANE. FOR THIS REASON, RECOVERY EFFORTS WERE FOCUSED IN AREAS WHERE CONSTRUCTION WAS <br />LIKELY TO DISTURB RECORD MONUMENTS. THE MONUMENT RECOVERY EFFORT FOR THIS SURVEY DID NOT <br />INCLUDE A SEARCH FOR ALL MONUMENTS WIYHIN THE CORRIDOR. ODOT SURVEY CREWS UTILIZED A LEICA <br />GS14 RECEIVER FOR GNSS AND LEICA TSI 5 & TS16 ROBOTIC TOTAL STATIONS FOR CONVENTIONAL <br />TERRESTRIAL OBSERVATIONS. MONUMENT RECOVERY OCCURRED BETWEEN MAY OF 2017 AND AUGUST OF <br />2017 WITH ADDITIONAL RECOVERY PERFORMED ON A RETURN TRIP AFTER RESCOPING IN MAY OF 2020. <br />CENTER LINE AND R/W RETRACEMENT <br />CENTER LINE <br />THE CENTER LINE ESTABLISHED IN THIS SURVEY IS INTENDED TO BE A RETRACEMENT OF THE CENTER LINE <br />DEPICTED IN MARION COUNTY SURVEY RECORD (MCSR) 2672 AND 4383 WHICH CORRESPONDS TO ODOT R/W <br />MAP 5B-1-1 7. THE DESCRIPTION IN MARION COUNTY COMMISSIONERS COURT JOURNALS RECORD VOLUME 25, <br />PAGE 377, THE OPENING OF MARKET ROAD 45, IS IN AGREEMENT WITH THE AFOREMENTIONED RECORDS. IN <br />ORDER TO ESTABLISH THE CENTER LINE, MONUMENT SEARCHES WERE PERFORMED AT THE INITIAL POINT OF THE <br />CENTER LINE, POINTS OF CURVATURE, POINTS OF TANGENCY AND POINTS OF INTERSECTION. THE RESULTS OF <br />THE SEARCH UNCOVERED POINTS 1077, 1002, AND 1000 AT THE APPARENT POINTS OF INTERSECTION. ALL <br />MONUMENTS ARE BRASS CAPS (SEE MONUMENT TABLE ON PAGE 4) AND ARE STAMPED "MARION COUNTY". <br />SINCE THESE MONUMENTS ARE NOT "ORIGINAL" AND NO DOCUMENTS WERE FOUND TO VERIFY THE METHOD <br />IN WHICH THESE MONUMENTS WERE SET, OTHER SURVEYS IN THE AREA WERE ANALYZED TO ASCERTAIN <br />WHETHER OR NOT BETTER EVIDENCE WAS AVAILABLE TO DISPROVE THEIR LOCATION. MCSR 4383 DEPICTS <br />MONUMENTS SET AT THE POINTS OF INTERSECTION, BUT IT APPEARS THAT THIS INFORMATION WAS ADDED <br />TO THE SURVEY IN 1975. OTHER SURVEYS PERFORMED IN THE AREA DO NOT INDICATE MONUMENTS FOUND <br />THAT REPRESENT THE LOCATION OF MARKET ROAD 45 WITH THE EXCEPTION OF THE INITIAL POINT (MONUMENT <br />REPRESENTED BY POINT 1077). HOWEVER, MCSR 31631 OFFERS A PLAUSIBLE EXPLANATION AS TO THE <br />VARIABILITY OF SOLUTIONS PRESENTED IN PAST SURVEYS. IN THIS SURVEY, 2 R/W LINES ARE DEPICTED WITH <br />REFERENCE TO BOTH MARKET ROAD 45 (INCLUDING THE CENTER LINE MONUMENTS SHOWN IN THIS SURVEY) <br />AND MCSR 6147 WHICH WAS PERFORMED IN JUNE OF 1917. IN THE NARRATIVE, THERE IS AN <br />ACKNOWLDEGEMENT OF THE POSSIBILITY OF SEVERAL LOCATIONS OF THE ROADWAY FROM THE LATE 1800'S <br />:THROUGH 1900'S. THE SURVEYOR IN THIS INSTANCE CHOSE TO ACCEPT THE HERRICK SURVEY (MCSR 6147) <br />FOR THE LOCATION OF THE ROADWAY AS IT RELATES TO THE SURVEYED TRACTS. ASSUMING THE RIDINGS <br />�.:TRACT (MCSR 3163 1) PREDATED THE HERRICK SURVEY, THE ACCEPTANCE OF THE ROADWAY AT THE LOCATION <br />117 SURVEYED IN 1917 IS CONSISTENT WITH THE PURPOSE TO "LOCATE THE BOUNDARY" OF SAID TRACT. THE <br />DIFFERENCE BETWEEN MCSR 31631 AND THIS SURVEY IS THAT THE PURPOSE OF THIS SURVEY IS TO IDENTIFY THE <br />LOCATION AND EXTENTS OF THE R/W OF MARKET ROAD 45 WHICH DEFINES THE EXTENTS OF WHAT IS NOW <br />p : KNOWN AS THE SILVER CREEK FALLS HIGHWAY (163). FOR THIS REASON AND THE LACK OF EVIDENCE TO <br />DISPROVE THE LOCATION OF THE COUNTY MONUMENTS, THE 3 MONUMENTS (1077, 1002, AND 1000) WERE <br />118 ; HELD TO DEFINE THE CENTER LINE OF MARKET ROAD 45. <br />R/W WIDTH <br />ODOT R/W MAP 5B-1-1 7 INDICATES A 60' R/W WIDTH (30' HALF) AND IS DATED APRIL 1936. IN THE SAME MAP, <br />2 A NOTE WAS ADDED NEAR THE INITIAL POINT AT AN UNKNOWN TIME THAT INDICATES A 50' R/W WIDTH. <br />ALMOST ALL OF THE SURVEYS WITHIN THE CORRIDOR AGREE WITH 60' R/W SHOWN ON THE 5B-1-1 7 MAP. <br />HOWEVER, IN VOLUME 25, PAGE 377 OF MARION COUNTY COURT RECORDS, THE COURT ORDERED THE <br />ESTABLISHMENT OF A ROAD "50 FEET IN WIDTH". EVEN THOUGH MOST OF THE SURVEYS WITHIN THE CORRIDOR <br />DEPICT EITHER A 30' HALF R/W OR A 60' FULL R/W, THE COURT MAINTAINS THE AUTHORITY TO ESTABLISH <br />ROADS BY PETITION.
