<br />ADJOINING SUBDIVISIONS. THE MAIN QUESTION POSED IN THIS SURVEY AS IT RELATES TO DEDICATION WAS WHETHER TO HOLD
<br />THE SUBDIVISIONS' OR PARTITION PLATS' ORIGINAL MONUMENTS OR TO HOLD THE BOUNDARY OF THE ROADWAY AS DEFINED BY
<br />THE SUBDIVISONS OR PARTITION PLATS. IN ORDER TO ARRIVE AT A SOLUTION, THIS SURVEY FIRST ANALYZED THE SUBDIVISIONS
<br />AND PARTITION PLATS FOR INTENT. IN OTHER WORDS, DID THE SUBDIVISION INTEND TO FOLLOW THE BOUNDARY OF MARKET
<br />ROAD 45 OR WAS THERE SOMETHING ELSE THAT WAS HELD TO DEFINE THE BOUNDARY ADJOINING MARKET ROAD 45. IF, FOR
<br />EXAMPLE, THE SUBDIVISION IN QUESTION HELD COUNTY MONUMENTS FOR THE MARKET ROAD, BUT DID NOT ARRIVE AT THE SAME
<br />SOLUTION/ LOCATION, THEN THE CONCLUSION OF THIS SURVEY WAS THAT THE INTENT WAS TO SPECIFICALLY FOLLOW MARKET
<br />ROAD 45? IF, HOWEVER, THERE WAS NO INDICATION ON THE PLAT THAT THE MARKET ROAD WAS RETRACED AND THE ORIGINAL
<br />MONUMENTS SUFFICIENTLY DISAGREE WITH THE BOUNDARY OF THE MARKET ROAD AS DEFINED BY THE COUNTY MONUMENTS,
<br />THEN THE ORIGINAL MONUMENTS OF THE SUBDIVISION WERE HELD. BELOW IS AN EXPLANATION OF THE SPECIFICS ENCOUNTERED
<br />FOR EACH SUBDIVISION WITHIN THE CORRIDOR.
<br />SILVER LOOP ADDITION, S10-1 59 WAS VACATED IN ITS ENTIRETY PER ORDINANCE NUMBER 138, VOLUME 149, PAGE 376 ON JUNE
<br />12, 1919 BY M J. VAN VALKENBURG, THE RECORDER AND CLERK OF THE CITY OF SILVERTON. DUE TO THE VACATION OF THE ENTIRE
<br />SUBDIVSION, R/W IS SHOWN AT A 25' HALF R/W WIDTH IN THE AREA FORMERLY OCCUPIED BY THE SILVER LOOP ADDITION PLAT.
<br />PARTITION PLAT 91-121 DOES NOT INDICATE THE METHOD UTILIZED TO ESTABLISH THE R/W ALONG S. WATER STREET. FOR THIS
<br />REASON, POINT 1067 AND 1081 (BELIEVED TO BE ORIGINAL MONUMENTS) WERE HELD TO ESTABLISH THE R/W FOR THIS PARTITION
<br />PLAT. THIS CREATES AN UNEVEN R/W WIDTH ALONG THE FRONTAGE OF THIS PARTITION PLAT.
<br />PARTITION PLAT 2002-22 AND 2002-23 UTILIZES COUNTY MONUMENTS AT POINTS OF INTERSECTION WITH A RECORD OF 6+56.7
<br />(POINT 1002 THIS SURVEY) AND 29+20.3 (POINT 1000 THIS SURVEY) TO ESTABLISH THE R/W ALONG MARKET ROAD 45. THOUGH
<br />THE BACK TANGENT WAS NOT ESTABLISHED IN THE SAME MANNER AS THIS SURVEY, THIS METHOD SEEMS TO INDICATE THE INTENT
<br />TO FOLLOW THE R/W ALONG MARKET ROAD 45 AS ESTABLISHED BY HOLDING THE COUNTY CENTER LINE MONUMENTS. RECORD HALF
<br />R/W WIDTH OF 30' HELD FROM CENTER LINE ESTABLISHED PER THIS SURVEY.
