<br />THE PURPOSE OF THIS SURVEY IS TO MONUMENT THE LINE BETWEEN SUBJECT
<br />TRACTS AS OCCUPIED. THE TRACT ALONG HOWELL PRAIRIE ROAD NE WAS
<br />CONVEYED TO WENDY AND GRANT ARON WIEGE BY STATUTORY WARRANTY DEED
<br />RECORDED IN REEL 4288, PAGE 207 (WIEGE TRACT). THE TRACT ALONG NUSOM ROAD
<br />NE WAS CONVEYED TO SAINT JOHN SOCIETY BY BARGAIN & SALE DEED RECORDED IN
<br />REEL 4430, PAGE 464 (SAINT JOHN TRACT). WIEGE AND THE GRANTOR OF THE SAINT
<br />JOHN TRACT, HERME H. RIVAS (FORMER DEED PER REEL 4370, PAGE 377) AGREED
<br />UPON THE LOCATION OF THE FENCE BETWEEN ADJOINING SUBJECT TRACTS. THEY
<br />ALSO AGREED THAT THE FENCE WOULD BE BUILT AND OWNED BY RIVAS, (NOW SAINT
<br />JOHN). THEREFORE, ALSO BY AGREEMENT BETWEEN WIEGE AND RIVAS, THE
<br />AGREEMENT LINE IS MONUMENTED TO ALLOW A 0.3 -FOOT OFFSET TO SAID FENCE.
<br />THE INTENT OF MONUMENTING THE AGREEMENT LINE IS FIRST, TO HONOR EXISTING
<br />OCCUPATION MARKED BY THE NORTH -SOUTH FENCE AND A PORTION OF THE
<br />EAST -WEST SHOWN, AND SECOND, TO RESOLVE AMBIGUITIES IN BOTH DEEDS THAT
<br />RESULT IN CONFLICTS BETWEEN THEIR COMMON BOUNDARY. THE MOST EASTERLY
<br />NORTH -SOUTH AGREEMENT LINE IS THE RESULT OF LANDOWNERS AGREEING TO AN
<br />EXCHANGE OF AREA ALONG WITH PAYMENT FOR WORK.
<br />I COMPUTED THE EXTERIOR DEED LINES AS FOLLOWS:
<br />NORTH EXTERIOR LINE IS HELD BETWEEN THE FOUND MONUMENTS #110 AND #135,
<br />SET IN MCSR 31140. 1 EXTENDED SAID LINE WESTERLY TO INTERSECT THE
<br />CENTERLINE OF HOWELL PRAIRIE ROAD.
<br />I HELD THE ROAD CENTERLINES, ESTABLISHED AS DESCRIBED BELOW, FOR THE
<br />WEST AND SOUTH EXTERIOR LINES PER THE DEEDS.
<br />I HELD THE EAST LINE OF THE SAINT JOHN SOCIETY TRACT BETWEEN FOUND
<br />MONUMENTS #135 AND #290. THE WOOD HUB #290, FOUND AND HELD TO CONTROL
<br />SAID EAST LINE, IS WITNESSED BY A FLAGGED STAKE, MATCHES CLOSELY THE
<br />POSITION COMPUTED FROM THE DETAIL IN MCSR 31140, AND APPEARS TO HAVE BEEN
<br />SET BY A SURVEYOR. ALTHOUGH NO ORIGIN COULD BE ASCERTAINED, A FIELD
<br />FENCE, ANCHORED AT EACH END BY WOOD POSTS, WAS BUILT ALONG SAID LINE
<br />BETWEEN #290 AND #135 PRIOR TO THIS SURVEY.

<br />HOWELL PRAIRIE ROAD (MARKET ROAD 51): THIS ROAD WAS MONUMENTED IN 1928 BY
<br />MARION COUNTY AND DOCUMENTED IN ROAD PLAT VOLUME 1, PAGES 282 - 284,
<br />WHICH WAS FILED AS MCSR 4765. 1 FOUND AND HELD THE MONUMENT AT THE
<br />CENTERLINE INTERSECTION WITH NUSOM ROAD NE AND THE MONUMENT MARKING
<br />THE P.I. OF THE NEXT CURVE TO THE NORTH. I HELD THE CENTRAL ANGLE OF 2002'
<br />AND THE COMPUTED RADIUS OF 2864.79 FEET TO ESTABLISH THE CURVE. SAID
<br />RADIUS IS COMPUTED FROM THE RECORD 2° CURVE, USING DEGREE OF CURVATURE,
<br />ARC DEFINITION. I THEN OFFSET CENTERLINE 30.00 FEET TO ESTABLISH THE
<br />EASTERLY RIGHT-OF-WAY LINE.
<br />NUSOM ROAD NE (COUNTY ROAD 634): THIS ROAD IS ALSO ESTABLISHED BY HOLDING
<br />FOUND CENTERLINE MONUMENTS. THE FIRST TWO ANGLE POINTS EAST OF THE
<br />INTERSECTION WITH HOWELL PRAIRIE ROAD WERE SET IN MCSR 29142. THE MOST
<br />EASTERLY CENTERLINE MONUMENT WAS SET BY MARION COUNTY IN 1952 AS
<br />DOCUMENTED IN MCSR 2458. 1 HELD THE RECORD HALF WIDTH OF 25.00 FEET TO
<br />ESTABLISH THE NORTH RIGHT-OF-WAY LINE.
<br />NUSOM ROAD NORTH RIGHT-OF-WAY ISSUE. IN 1987, IN MCSR 31140, CLARENCE
<br />BARKER COULD NOT RECONCILE THE ROAD ALIGNMENT WITH THE DEED CALLS.
<br />BARKER THEREFORE SHOWS TWO VERSIONS OF THE ROAD ALIGNMENT. A READING
<br />OF THE CURRENT DEEDS REVEALS THAT THE ISSUE STILL EXISTS. I LEAVE IT TO
<br />MARION COUNTY TO SETTLE THE MATTER. MEANWHILE THE MONUMENTS SET IN THIS
<br />SURVEY ALONG THE ROAD ARE INTENDED TO MARK THE RIGHT-OF-WAY AS
<br />MONUMENTED BY MARION COUNTY.
<br />BASIS OF BEARINGS IS THE LINE BETWEEN THE FOUND MONUMENTS #100 AND #115,
<br />WHICH LINE BEARS S 89036'16" E. BEARINGS ARE BASED ON "OCRS (OREGON
<br />COORDINATE REFERENCE SYSTEM) SALEM ZONE" NAD 1983(2011) EPOCH 2010.00,
<br />INTERNATIONAL FEET, ESTABLISHED PER TRIMBLE VRSNOW OREGON GPS NETWORK.
