MCSR 39722 <br />NARRATIVE <br />This survey was made to provide a professional opinion as to the location of <br />the land described in Reel 4206, Page 105 of the Marion County Records, <br />and to place monuments at the corners. This tract of land was not previously <br />surveyed. This tract and the two tracts lying south of it were originally <br />conveyed on the some day. At first look, the location relative to the highway <br />would place the three tracts in conflict with the westerly adjoining property. <br />However, a comparison of the descriptions with Survey No. 23578 by David <br />Bascue reveals that whoever wrote the description did so in view of Bascue's <br />survey. Bascue did not have sufficient evidence of the highway right—of—way. <br />He indicates a straight line where the highway map and deed indicate a spiral <br />curve. The deeds use information matching the Bascue survey. Because <br />doing otherwise would cause conflict, the deed descriptions must be <br />construed together and in light of the Bascue survey. The south line of the <br />group of three descriptions is on or parallel to the south line of a larger <br />rectangle that was surveyed by W.J. Knox (see Survey No. 6214). Both of <br />Knox's pipes for this line are now missing. At the west end of the line, I had <br />previously located Knox's pipe and now have calculated its location based on <br />my prior survey. At the east end, Knox's record distance from the section <br />line was used. For the east line, found monuments that were likely set by <br />Oregon State Highway Department were used along with record data from <br />their Map 713-25-9. For the north line, the County monument at the north <br />quarter corner for Section 3 and the record offset from Bascue's monument at <br />Dominic Road were used. Bascue previously had a Knox monument on the <br />Section line, near the intersection. Using this line best matches Knox's <br />survey. The south line was set using record distance along Bascue's version <br />of the Highway right—of—way and parallel to the south line of the larger <br />rectangle that the three tracts along the highway were divided from. For the <br />west line, it is clear from the bearing that the three tracts are intended to have <br />a common west line. Record distance at the south line of the three and the <br />north line of the three was used. The resulting line, being only slightly over a <br />minute off, for all practical purposes "perpendicular" to the south line as <br />some of the descriptions call for. The resulting distance along the lines <br />between the three tracts are within the practical limits of measuring and, <br />therefore, match record.
