In addition, the north and northwest lines were marked with wooden stakes. <br />The legal description in Reel 4356, Page 93 has its origin with Survey 28945 by E.L. DeSantis, Jr., as does the description in Reel 4062, Page 472. <br />DeSantis' survey is an original survey for the northwest line. His monument and his record information, where that monument was missing, was used for the line. <br />At the north line, Reel 945, Page 370 calls for a fractional part of the section. Reel 4356, Page 93 has a metes and bounds description based on DeSantis' survey and contains calls <br />for the corners of the adjoining property. At first glance, DeSantis' note, "Section was not subdivided: all boundaries based on existing monuments found & previous surveys" <br />may cause concern. However, DeSantis note indicates that the property had been previously surveyed. Although the survey is not filed with the Marion County Surveyor, similar <br />monuments have been called for in other parts of the section. As early as 1949, S. Simms called for a monument found at the center of section that was "set by some former <br />surveyor". Similarly, there is an iron pipe called off at the west quarter corner that is of unknown origin. Because the DeSantis family had long resided in this area, it is likely that <br />they had knowledge of some former, unrecorded survey, which had subdivided the section. Because these monuments were set so long ago, it would be nearly impossible to find <br />evidence showing that they were beyond mere technical error or were set with less than strict adherence to restoration and subdivision rules. When the survey was done, the lines <br />were run and marked; the corner positions were fixed by a local survey. The 2009 BLM Manual says, "The law gives these activities repose." Further reinforcing the decision to <br />use DeSantis' line is the longstanding fence that runs to the points indicated by DeSantis, indicating that the property owners have long acquiesced to them as marking the property <br />line. At the east end of the line, the monument indicated by DeSantis is no longer in place. It's position was determined using his record measurements and extending slightly to <br />meet with the east line as monumented by Bates in his survey of Spring Villa Subdivision. <br />For the east line, I have accepted the west line of Spring Villa Subdivision. Monuments for several of the lot corners along that line were found and accepted. <br />MCSR 39740 <br />
