MARION COUNTY
COMMUNITY DEVELOPMENT DEPARTMENT
BUILDING INSPECTION DIVISION

CRAIG O. LUEDEMAN
Director
Planning/En£or~ement 588-5038
Building In~pectlon 588-5147

Senator Building - 220 High Street NE - Second Floor · Salem, Oregon 97301-3670

November 10, 1987

MEMORANDUM

TO: Kevin Hills
PO Box 463
Detroit, Oregon

FROM: Robert Foster, RS

SUBJECT: Sewage System Setbacks from Streams.

This memo is in answer to your questions concerning the drain-
field setbacks which would be required from the stream which runs
through your property in Detroit. The property is identified as
Lots 1 through 5, Block 2 in Patton 3rd Addition Subdivision in
the City of Detroit.

The stream which runs through this property apparently flows only
during a portion of the year and does not flow continuously
throughout the year. The flow which is present at this time has
been identified by Detroit city officials through tests for
chlorine as water leakage from the city water system and is not
normal water flow for this area.'~ Since the stream flows for a
period greater than two months but does not flow continuously
throughout the year, it can be classified as an Intermittent
Stream. The D.E.Q. On-Site Sewage Disposal Rules require a
m~nlmum setback of fifty (50) feet between an intermittent stream
and a septic tank and drainfield.

I am sending a copy of this memo to the City of Detroit and I
would encourage the city to actively pursue the repair of the
water leak which is causing the added water flow through your
property.

I hope this answers your questions. If you have any further
questions, please contact me at this office.
