We
have had numerous phone conversations with various mem-
bers of your staff and seem to be getting different
answers each time.

You will find attached, a copy of a letter from the City
of Aumsville. While Aumsville is not the only jurisdic-
tion experiencing these problems, they are asking very
similar questions. In addition to the specific questions
identified in their letter, I am requesting answers to
the following general questions:

Do local jurisdictions have the authority to adopt
and enforce greater set back requirements than
found in administrative rule?

gxample - an accessory building shall not be
located closer than six feet to any mobile
home or other accessory building on adjacent
space. Can local jurisdiction change the six
feet to ten feet? A mobile home may not be
closer than five feet to a property line. Can
local jurisdiction change the five feet to a
greater set back?

Can the State Fire Marshal adopt and enforce
regulation for street access and location of
hydrants? This issue is not addressed in the
administrative rule.

Senator Building 220 High Street NI~ Salem, Oregon 97301-3670
