Community [3evelopment
Building ]ns~.ction Division
Marion County
OREGON

INSTRUCTIONS
TWO PARTY EASEMENT FORM

These instructions are intended to assist in the completion of an
easement involving two tax lots or parcels with two separate
owners. Generally, a portion of one lot is being reserved for a
sewage system which will serve a house on the second lot.

The Department of Environmental Quality On-Site Sewage Disposal
Rules, Section 340-71-130 (ll)(a) state:

A recorded utility easement and covenant against conflicting
uses, on a form approved by the Department, is required
whenever a system crosses a property line separating proper-
ties under different ownership. The easement must accommo-
date that part of the system, including setbacks, which lies
beyond the property line, and must allow entry to install,
maintain and repair the system.

Please follow these instructions carefully:

Submit two copies of a site plan, certified by an engineer
or land surveyor registered with the State of Oregon,
showing the boundaries of the easement area and the bound-
aries of the parcel where the house will be located. If the
attached easement form is used, the engineer or land survey-
or must enter the required legal descriptions in the appro-
priate sections of the form. An easement may be granted for
an entire parcel, in which case the legal description for
the parcel would be entered as the legal description of the
easement area.

Submit two copies of a building site plan, prepared to scale
and illustrating the location of all proposed and existing
structures, water supplies and sewage systems. The proposed
septic system must be staked out on the property to insure
that the system will fit within the boundaries of the
easement area.

The easement must be completed and submitted to this office
for review prior to being recorded. Include an Marion County
Assessors map which clearly shews all the dimensions of the
properties involved. If approved, the easement must then be
recorded. A copy of the recorded easement must be submitted
to this office. After a copy of the recorded easement has
been returned to this office, a report can be issued for
your property.

MC15-10
R~'W10-92

(503) 588-5147

Senator Building, 2nd Floor
220 High St. NE · Salem, OR 97301~3670
