SEWER EASEMENT <br /> <br />THIS I2qDE, NTUKE WITNESSETH, that ~'/q/'ff?' <br /> <br />(Grantors) <br /> Dollars <br /> <br />for the¢onsideratiOn of .... <br />to ~//:} paid, and of the mutual covenants hereto contained, do hereby grant and convey <br />unto the City of Aumsville, a municipal corporation (Grantee) a fight-of-way and easement for a <br />sanitary sewer over and across the following described real property: <br />A 20.00 foot wide strip of land, the centerlin~ of which is described as follows: <br /> Beginning at a point on the easterly, line of a public street which point bears North <br />11°58'59" East 743.87 feet from the northerly Southwest corner of the Oliver P. Taylor <br />Donation Land Claim No. 45 ir~ Section 30, Township 8 South, Range 1 West of the Willamene~ <br />Meridian in Marion County, Orogon; thenc~ South 85°52'34 <br />terminus. <br /> <br /> together with a temporary working easement ~s follows, to wit: <br /> ALSO a 40.00 foot wide tempor~'y cons~'udtion easement the centerline of which is described <br /> as follows: / <br /> Beginning at a point on the easterly line of a public street which point bears North <br /> I1°58'59' East 743.87 feet from the nortMfiy Southwest comer of the Oliver P. Taylor <br /> Donation Land Claim No. 45 in Section 30, Township 8 South, Range 1 West of the Willarnetle <br /> Meridian in Marion County, Oregon; thenc~ South 85°5T34'' East 776.00 feet to the point of <br /> termh~us, <br /> <br /> The temporary working easement shall be effective only for and during the time of the <br />initial construction and laying of the pipeline hereinafter as follows: <br /> <br />TO HAVE AND TO HOLD the above described fight-of-way unto said grantee in accordance <br />with the conditions and covenants as follows:. <br /> <br /> 1. TM grantee, through its officers, employees and agents, shall have the fight to enter <br />upon said lands in such a manner and at such times from this date as may be reasonably <br />necessary for the purpose of constructing, building, laying, patrolling, replacing and maintaining <br />thereon a sewer line along said right-of-way for the conveyance of sewage, including such <br />renewals, repairs, replacements and removals ~s may be from t/me to time required. Said fight <br />shall be perpetual so long as grantee shall ol~erate a sewer line for carrying sewage as herein <br />provided, but should grantee cease to use saic~ line for a period of one year, then this easement <br />shall become null or void, and all sewer lines of appurtenances thereon installed in or upon said <br />land shall be removed by the grantee within a reasonable time. <br /> <br /> 2. Said sewer line shall be so laid that the top thereof shall be buried not less than <br />th/try-six inches below the natural surface of tM ground. <br /> <br /> <br />
