The Marion county Building
Department has included documentation .that the on-site
sewage disposal system that Serves the Korner Post
Restaurant located at 100 Detroit Avenue in Detroit,
Oregon, has failed, as evidenced by septic tank effluent
pending in a pit that is exposed to the ground surface.
This condition constitutes a public health hazard as
defined in Oregon Administrative Rules (OAR) Chapter 340,
Division 71-100(90), and violates the provisions of OAR
Chapter 340-71-130(3) which states:

"Discharge of Sewage Prohibited. Discharge of
untreated or partially treated sewage or septic tank
effluent directly or indirectly onto the grOUnd
surface or into public waters constitutes a public
health hazard and is prohibited.'"

Marion County Building Department staff first became aware
of this violation on April 27, 1992. Staff from that
Department have contacted you several times An person and
by mail to attempt to resolve this problem. A visit by
Marion ~ounty staff to the site on December 11, 1992,
revealed the effluent (in an open pit) was still exposed
to t~e ground surface. A letter dated December 16, 1992,
was mailed to you by Marion county staff requesting
submission of plans for repair immediately. That
Department received no response to their letter and have
referred the case to the Department of Environmental
Quality.

~;utte 1110
Salem, OR 97310
(503) 378-8240
