CommUnally t~w¢lopment <br />BulldinB Instruction D~vlslon <br /> <br />Marion County <br /> <br />OREGON <br /> <br />These instructions are intended to assist in the completion of an <br />easement involving two tax lots or parcels with two separate <br />owners. Generally, a portion of one lot is being reserved for a <br />sewage system WhiCh will serve a house on the second lot. <br />The Department of Environmental Quality on-Site Sewage Disposal <br />Rules, Section 340-71-130 (~1) (a) state: <br /> A recorded utility easement and covenant against conflicting <br /> uses, on a form approved by the Department, is required <br /> whenever a system crosses a property line separating proper- <br /> ties under different ownership. The easement must accommo- <br /> date that part of the system, including setbacks, which lies <br /> beyond the property line, and must allow entry to install, <br /> maintain and repair the system- <br /> <br />follow these instruotions carefully: <br /> <br />Submit two copies Of a site plan, certified by an engineer <br />or land surveyor registered with the State of Oregon, <br />showing the boundaries of the easement area and the bound- <br />aries of the parcel where the house will be located- If the <br />attached easement form is used, the engineer or land ~urvey- <br />or must enter the required legal descriptions in the appro- <br />priate Sections of the form. An easement may be granted for <br />an entire parcel, in which case the legal description for <br />the parcel would be entered as the legal description of the <br />easement area. <br /> <br />Submit two copies of a building site plan, prepared tO scale <br />and illustrating the location of all proposed and existing <br />structures, water supplies and s~wage systems. The proposed <br />septic system must be staked out on the property to insure <br />that the system will fit within the boundaries of the <br />easement area, <br /> <br />The easement must be completed and submitted to this office <br />for review prior to being recorded. Include a~ Marion County <br />Assessors map which clearly shows all the dimensions of the <br />properties involved. If approved, the easement must then be <br /> <br />to %Bis offlee.
