section is not a land use decision, as defined in ORS 197.015, and is not subject to review by the Land Use <br />Board of Appeals and is not a permit, as defined in ORS 215.402 or 227.160. <br /> <br />2. Events on days seven through 18 of the 18-day limit per calendar year shall be authorized by the local <br />government through the issuance of a renewable multi-year permit that has a term of five years, is subject <br />to an administrative review to determine necessary conditions pursuant to subsection (F) of this section, <br />and is subject to notice as specified in ORS 215.416(11) or 227.175(10). The permit described in this <br />section is a land use decision, as defined in ORS 197.015, and is subject to review by the Land Use Board <br />of Appeals and is a permit, as defined in ORS 215.402 or 227.160. <br /> <br />The applicants plans on conducting up to 18 private commercial events per year. They state that these special events <br />will be a minor component of the overall winery sales. The persons renting the facilities for private events will be <br />required to purchase wine from the winery and feature that wine at the event. In order to help ensure that the events <br />serve as a marketing tool for the wine, the winery event contract will state that the applicant’s wine is required for <br />each event and the contract will further require that the applicant’s wine be featured at each event. <br /> <br />The applicant will accept as a condition of approval, the requirement to obtain the necessary renewable multi -year <br />license for the first 6 of 18 events in a year and if it surpasses 6 events in a year the applicant will obtain another <br />renewable multi-year license for events 7 through 18 of that same year. The criteria in section (E) shall be made a <br />condition of approval. Ther criteria are met. <br /> <br />F. As necessary to ensure that agri-tourism or other commercial events on a tract occupied by a winery are <br />subordinate to the production and sale of wine and do not create significant adverse impacts to uses on <br />surrounding land, the local government may impose conditions on a license or permit issued pursuant to <br />subsection (E) of this section related to: <br /> <br />1. The number of event attendees; <br />2. The hours of event operation; <br />3. Access and parking; <br />4. Traffic management; <br />5. Noise management; and <br />6. Sanitation and solid waste. <br /> <br />To address (F), the applicants stated that to ensure that agri-tourism or other commercial events at their winery are <br />subordinate to the production and sale of wine and do not create significant adverse impacts to uses on surrounding <br />land, the applicant suggests the following <br /> <br />(a) The number of event attendees shall be capped at a max of 120 guests and l 0 staff. <br />(b) The hours of event operation shall not exceed 11 am to 10 pm. <br />(c) Access and parking shall be adequate to accommodate emergency vehicles and 70 cars. <br />(d) Traffic management shall be orderly, safe, and quiet. <br />(e) Noise management shall include a ban on outdoor amplified music and noisemakers. <br />(f) Sanitation and solid waste shall be subject to approval by the county sanitarian. <br /> <br />These criteria in section (F) shall be conditions of approval and with the applicant’s agreement to the said criteria, <br />the criteria are met. <br /> <br />G. A winery operating under this section shall provide parking for all activities or uses of the lot, parcel or tract on <br />which the winery is established. <br /> <br />For access and parking, the applicants state that there will be no on-street parking on Marion Hill Rd SE. There will <br />be no parking allowed on neighboring parcels nor obstruction of neighbors' driveways, unless it is done with the <br />express written permission of those landowners. The driveway onto the winery’s property and Marion Hill Rd SE <br />will not be blocked or obstructed in any way. The applicants have sufficient room to safely accommodate 70 vehicles <br />and still maintain internal circulation and fire apparatus road access. The parking lot layout for both the primary and <br />overflow parking areas can accommodate up to 70 total cars spaces with 4 being ADA accessible and there will be <br />areas where motorcycles can park. The subject property could hold an additional 43 cars on the NE portion of the <br />property adjacent to the driveway. <br />
