Tax lot 2000 is a lawfully created parcel of 2.10 acres and has remained in its configuration created since the last
<br />known land use case with Marion County.
<br />Tax Accounts 2200, 2400, 2600 (2201, 2102)
<br />As of September 1, 1977, tax lots 2200, 2400, and 2600 were parts of two different parcels. TL 2200 was part of a
<br />larger 26 acre parcel described by deed Volume 598, Page 424 (March 18, 1965). While TL 2400 and 2600 were
<br />together as one 5 acre parcel also described in the same deed – but a separate legal parcel. This also shows that TL
<br />2201 was also a part of this configuration prior to 1977.
<br />This configuration changed in 1987 by P87-053 where TL 1900 was reconfigured to meet its current legal
<br />description as listed in deed Instrument Number 2025-05579 (February 28, 2025). This land use case also created
<br />TL 2000 in its current legal configuration as listed in deed Reel 894, Page 445 (October 24, 1991).
<br />This land use case also modified the property lines of TL 2100 and 1900 (Adjusted Parcel 1) to expand TL 2100
<br />to its current configuration as listed in deed Reel 1181, Page 423 (July 24, 1994) as 8.28 acres. The rest of the
<br />land in this land use case is modern day TL 2102, 2201, 2200, 2400, 2600 as Adjusted Parcel 2 as 15.78 acres.
<br />In 1990 the area was described and transferred by deed as part of an approximately 26 acre parcel and a 5 acre
<br />parcel that contains current tax accounts 1900, 1901, 2100, 2102, 2201, and 2200 as one parcel and 2400 and
<br />2600 as a separate parcel (Reel 811, Page 405; November 10, 1990).
<br />Tax lot 2400 was never lawfully partitioned after 1987 (P87-053) when it was recombined with the rest of the
<br />15.75 acres. Tax lot 2600 was never transferred by deed or land use case since it was created by deed in 1976
<br />(Reel 37, Page 404; Feb 19, 1976) until 1992 (Reel 961, Page 354, June 18, 1992). This was after the tax lot was
<br />reconsolidated with Adjusted Parcel 2 in 1987.
<br />Staff concludes that these tax lots are parts of the original parcels in question along with 2201 as a portion of
<br />Adjusted Parcel 2: TL 2102, 2201, 2200, 2400, 2600 as one 15.78 acre parcel.
<br />Tax Account 2200
<br />Tax lot 2200 is part of a larger 15.78 acre parcel that resulted from the partition case in 1987 (P87-053) and is
<br />referenced as Adjusted Parcel 2. This parcel should include modern day tax lots 2102, 2200, 2201, 2400, and
<br />2600. This is reflected in Survey 31264 that was prepared after partition case P87-053 was approved by the
<br />Marion County Planning Director on April 15, 1988. A deed was recorded as Reel 1181, Page 422 on July 25,
<br />1994, for this configuration. According to the applicants, they did not immediately record the new deeds created
<br />as a result of the partition and survey in 1987 (P87-053). As a condition of approval for P87-053, the Applicants
<br />were required to record the final partitioning map with the Marion County Clerk, which they did in April 1988.
<br />Another condition of approval was that “After the final partitioning map has been recorded no alteration of
<br />property lines shall be permitted without first obtaining approval from the Planning Director.”
<br />Marion County Planning Staff were able to find evidence that TL 2600 was separated by deed in 1976 (Reel 37,
<br />Page 404; February 19, 1976). This was before the September 1, 1977, date that acts as the cutoff for land
<br />divisions and property line adjustments without land use approval from the County. However, P87-053
<br />recombined TL2600 with Adjusted Parcel 2. Therefore, Tax lot 2200 is a part of an approximately 15.78 acre
<br />parcel of land that contains the following tax lots: 2102, 2200, 2201, 2400 and 2600.
<br />In 2025 the applicants recorded deed Instrument Number 2025-020875 (July 3, 2025) that uses a new legal
<br />description that removes modern TL 2201 from the description and includes a portion of TL 1900 and describes it
<br />as approximately 8.4 acres. This deed modifies two parcels that were created by a legal land use case in 1987
<br />(P87-053), making the resulting parcel an unlawfully created parcel. Furthermore, this deed contains a copy for
<br />deed Reel 4428, Page 203 (December 28, 2020) with a page titled “Exhibit A” that contains the proper legal
<br />description from P87-053 and identifies it as a 15.78 acre parcel of land.
