Youth With a Mission initially obtained approval to operate <br />the campus in 1980, and expansions were approved in 1981,1984, 1990, 1999, 2002, and, most recently in 2021 <br />(CU21-004). ZC/CP/CU/LLA01-002 established the property’s existing configuration and validated the property <br />as legal for land use purposes. <br /> The bridge to be repaired provides access to the camp facilities on the west side of Battle Creek. It is currently <br />load restricted and does not meet width requirements for the Tuner Fire District. The applicant submitted a <br />hydraulics report and bridge plans, indicating the bridge will be wider and longer and fill will need to be added to <br />keep the bridge out of the 100-year floodplain. <br /> <br />3. All surrounding properties to the north, east and south are located in the AR zone and the property to the <br />northwest is zoned SA (Special Agriculture). Some surrounding properties are owned by Youth with a Mission <br />and some are privately owned, developed with acreage homesites. <br /> <br />4. The applicant is proposing one structural project: to repair an existing road bridge over Battle Creek. The other <br />items proposed are riparian repair and enhancement; no structures are proposed in this section of the project. The <br />applicant provided evidence that alterations to the bridge are necessary to meet the load requirements for the <br />facility and fire department standards. <br /> <br />5. Agencies were notified with a request for comment. <br /> Marion County Septic commented: <br /> Condition of Approval: “A septic pressure line was installed on the bridge and will need to be moved during and <br />after construction. Therefore, a Septic Minor Alteration permit will need to be applied approved with the <br />construction of the bridge.” <br /> Marion County Building Inspection commented: <br /> “No Building Inspection concerns as the roadway access bridge is not under the authority of the state building <br />code. No structural permit is required for this bridge. Any adjustments or repairs or alterations to existing utilities <br />would require permit(s) be obtained prior to this work.” <br /> Oregon Department of State Lands commented that a removal-fill permit may be required for projects that add, <br />remove, or move material to wetlands, streams, and other waterways. <br /> The Rural Battle Creek Road Association community group provided comments indicating concern of the project. <br /> No other agency provided comments for this proposal. <br /> <br />6. The purpose of the Floodplain Overlay Zone is to promote public health, safety and general welfare to minimize <br />public and private losses due to flood conditions. In order to ensure that the development is reasonably safe from <br />flooding, the County requires the development comply with the criteria and standards listed in Section 17.178.050 <br />and 17.178.060 of Marion County Code (MCC). <br /> <br />7. The property is on Flood Insurance Rate Map # 41047C0676J in an unnumbered “A” floodplain zone with no <br />Base Flood Elevation established by FEMA. The applicant’s representative performed hydrology analysis for the <br />project, providing floodplain elevation projections along this portion of Battle Creek. They established a Base <br />Flood Elevation at the proposed project location of 370.70 feet. Furthermore, they provide the proposed bridge <br />low soffit elevation at this location to be 371.74 feet, indicating the lowest point of the bridge to be over one foot <br />above the base flood elevation. <br /> <br />8. Marion County Code 17.178.050 C & D pertains to this project: <br /> <br /> C. Prior to obtaining a building permit the owner shall be required to sign and record in the deed records for the <br />county a declaratory statement binding the landowner, and the landowner’s successors in interest, acknowledging <br />that the property and the approved development are located in a floodplain. <br /> <br /> This declaratory statement shall be a condition of approval. <br />
