S P '1.~•9. <br />2.6 CONSTRUCTION PHASE-ADMINISTRATION <br />OF THE CONSTRUCTION CONTRACT <br />2.6.1 The Architect's responsibitin- to provide Basic <br />Services for the Construction Phase under this Agreement <br />oommences with the a~vard of the Contrad for Construction <br />and terminates <br />GO da~~s after the date of <br />Substantial Completion of the Work. <br />2.6.2 The Architect shall provide administration of the <br />Contract for Construction as sel forth belo«~ and in the <br />ediGon of AIA Document A201, General Condilions of the <br />Contrad for Constniction, current as of thc date of this <br />Agrcement, unless othen~nse pro~~ided in this Agreement. <br />~ 0.3 DuGes, responsibilities and limitalions of authority <br />of lhe Architect shall not be restricted, modified or e~.-tended <br />without written agreement of the Otvner and Architect.w~i# <br />2.6.4 ~ The Architect shall <br />ad~~ise and consuli ~vith the O~mer (1) during construction <br />untii final payment to the Contractor is due. and (2) as an <br />Additionat Service at the O~~rner's direciion from time to <br />time during the correction period described in the Contract <br />for Construction. The Architect sliall not be <br />responsible for the Coniracior's schedules or failure to carn~ <br />out the Work in accordance ~vi[h the Contract Documents. <br />The Architect shatl not have oontrol over or charge of acts or <br />omissions of tlie Contractor, Suboonlraclors, or their agenls <br />or emplo~~ees, or of any olher persons pertorming poctions of <br />the Work. <br />2.6.7 The Architecl shall al all times lia~~e access to the <br />Work ~~fierever it is in preparation or progress. <br />2.6.8 Excepl as may othen~7se be provided in the <br />Contract Documents or ~vhen direct communications tMpe <br />been specially aulhorized, lhe O~~~ner and Contractor~s~ <br />communicate through lhe Archiled. Communications by <br />and with the Architect's oonsultants shali be through the <br />Archilect. <br />St¢, SP 2.f~.ti.\ -~•b•4•Z Ak t~c s:ac <br />2.6.9 Based on tlie Architect's obsen~ations ~ and <br />e~~aluations of the Contractor's Applications for Pa~°ment, the <br />Architect shall revie~v and certif~r the amounts due the <br />Contractor. _ <br />2.6.10 The Architect's certification for payment shatl <br />constitute a representalion to the O~vner. based on the <br />Architect's observations at the site as pro~~ided in <br />Subparagraph 2.G.5 and on the data comprising the <br />Contractor`s Application for Pa~=menl. that the Work has <br />progressed to the point indicated and that~ to the best of the <br />Architect's kno~vtedge, information and belief. qualin• of the <br />Work is in accordance ~vitl~ the Conlract Documents. The <br />foregoing representations are subject to an e~~aluation of the <br />Work foc conformance ~vith thc Contract Documents upon <br />Substantial Completion, to results of subsequent tests and <br />inspections, lo minor de~~iations from the Contract <br />Documents correctabte prior to comptetion and to specific <br />qualifications expressed by the Architect. The issuance of a <br />CeRificate for Payment shall further constitute a <br />representation that the Contractor is eniitled to pa~'ment in <br />~ the amounl ceriified. Ho~~•e~~er. lhe issuance of a Certificate <br />for Payment shall nol be a representation that the Archilect <br />lias ( t) made exhausli~~e or continuous on-site inspections to <br />c(ieck the qualit~~ or quantit~° of the Work.
