SUPPLEMENTAL PROVISIONS <br />The following supplements modify, change, delete from or add to AlA Document B 141, Standard Form of <br />Agreement Belween Owner and Architect (1987 Edition). Where any Article, Paragraph, Subparagraph or <br />Clause of the B141 form is modified, changed, deleted from or added to by these Supplemental Provisions, the <br />unaltered provisions of that Article, Paragraph, Subparagraph or Clause shall remain m effect. Where any part <br />of the B 141 form is in conflict with these Supplemental Provisions, these Supplemental Provisions shall <br />govem. Where any part of the B 141 form or these Supplemental Provisions are m conflict with the FTA <br />Addendum, the FTA contract requirements sha118ovem. <br />1.1.0 The Owner and Architect aclrnowledge and agree that the Architect commenced performing design <br />services for this Project in June 1996, on behalf of the Owner. The parties agree that ttus Agreement relates <br />back to the time of commencement of the Arclutect's services for this Project. <br />1.1.2.1 The Architect shall provide to the best of its ability services under this Agreement in conformance <br />with the detailed schedule for the Architect's services prepared by the Architect and approved by the Owner <br />pursuant to SubparagraPh 1.'..2. <br />1.1.4 The Architect warrants that it is licensed to perform architectural services in the state of Oregon <br />and that it or the parties or persons that perforn- engineering services under this Agree~nent aze licensed to <br />perform engineering services m the state of Oregon. <br />1.1.5 The Architect and its cansultants shall perform all services under this Agreement in a mamier <br />consistent with the degree of care and skill ordinarily and customarily exercised by members of the same <br />profession currently practicin8 under similar circumstances. <br />1.1.6 The Architect and its consultants shall co?nP1Y with aPPlicable federal, state, and local laws, <br />statutes, codes, rules, regulations, and orders in perfornung the Architect's obligations under this Agreement. <br />1.1.7 The Owner reserves the right to enter into additional agreements with third Parties to perform <br />ar~hitectural and engineering services related to the Project. The Owner further reserves the right to terminate <br />certain of the Architect's obhgations under this Agreement and to perform such obligations itself or to enter <br />urto agreements with third parties to perform such obligations. In the event the Owner t~:rminates certain of the <br />Architect's obligations pursuant to this Subparagraph, the Architect's comPensahon under this Agreement <br />shall be equitably adjusted. <br />2.2.4.1 The Schematic Design Documents shall comply with applicable laws, statutes, ordinances, codes, <br />orders, rules and regulations. <br />2.3.1.1 The Design Development Documents sha11 comply with applicable laws, statutes, ordinances, <br />codes, orders, rules and regulations. <br />2.4.1.1 The Construction Documents sha11 comply with applicable laws, statutes, ordinances, codes, <br />orders, rules and regulations. <br />2.4.5 Unless directed by the Owner otherwise, the Architect shall also prepaze the final Drawings on <br />computer-aided design disks. <br />2.4.6 The Owner's review and approval of the Schematic Design Documents, the Design Development <br />Documents and the Drawings and Specifications (both preliminary and final) during the Schematic Design <br />Phase, Design Development Phase or Construction Documents Phase, or at any other time, shall not relieve the <br />Architect of its responsibilities for the final Drawings and Specifications. <br />Courthouse Square Project <br />~ Architect Agreement Supplemental Provisions <br />Page - 1 <br />
