JOHNNIE
ATTORNEY AT LAW
SHERMAN, SHERMAN & MURCH
PO BOX 2247
SALEM OR 97308
Re: COURTHOUSE SQUARE/ARCHITECT CONTRACT
Deaz Gina:
Edward L. Clark, Jr.
Retired
I am enclosing a revised FTA Contract Addendum, with special provisions for the architect.
Following discussions with Kim and Alan, the Addendum has been revised to include the language: "In
connection with the performance by contractor of work or services within the scope of this Agreement," at
the beginning of each major section. Additionally, a provision has been made for payment of bond
premiums, in the event that the owner requires payment or performance bond after execution of the
contract. Finally, the seismic safety paragraph has been revised to change the wording "will be designed
and constructed" to read, "will be designed and, subject to the scope of Contractor's obligations under
Section 2.6.5,".
With these changes, I think that we are finished. The principals still will need to come to terms on the
scope of services and the fee before execution of the document.
Best regards.
Very truly yours,
~s~ BEN C.
