Before the Board of Commissioners <br />For Marion County, Oregon <br />In the matter of expressing) <br />the county's intent to acquire) <br />flnancing for its share of the) <br />Courthouse Square project) <br />and providing reimbursement) <br />of federal funds if the project) <br />is not completed.) <br />Resolution # ~~ ~ ' ~ 1 <br />This matter comes before the Marion County Board of Commissioners at a regular public meeting <br />on November 27, 1996, to consider the county's intent to acquire financing for Courthouse <br />Square and reimbursement bf federal funds if the project is abandoned by the county. <br />WHEREAS, the Board has previously entered into preliminary agreements with the Salem Area <br />Transit District (Transit) to acquire federal funding for the development of Courthouse Square <br />and , <br />WHEREAS, the Board has authorized the Director of General Services to enter into agreements <br />with the private developer, Dan Beney (DBA Courthouse Square Inc.), and <br />WHEREAS, the Board has authorized the Director of General Services to proceed with the <br />acquisition of three parcels in the 500 block of Court Street NE which are necessary for the <br />development of Courthouse Square, and <br />WHEREAS, the Federal Transit Administration (FTA) has requested that the county express <br />intent to acquire financing for its share of the project (estimated at $14 million) and to assure FTA <br />that the county will reimburse Transit and/or FTA for federal funds used on property acquistion <br />and other related expenses if the project is abandoned by the county, now, therefore, <br />BE IT RESOLVED, that the Board of Commissioners hereby authorizes the County <br />Administrative Officer to proceed with ageements and contracts for Bond Counsel and <br />Underwriter services that will allow the county to acquire the necessary funding for our share of <br />the Courthouse Square project <br />BE IT FURTI~R RESOLVED, that the county recognises that federal funds, administered by <br />FTA, and used to acquire an undivided interest in the land for the Transit District shall be <br />reimbursed to Transit/FTA if the county abandons the project. <br />
