Resolution # ~~ ~ ' ~ 1 This matter comes before the Marion County Board of Commissioners at a regular public meeting on November 27, 1996, to consider the county's intent to acquire financing for Courthouse Square and reimbursement bf federal funds if the project is abandoned by the county. WHEREAS, the Board has previously entered into preliminary agreements with the Salem Area Transit District (Transit) to acquire federal funding for the development of Courthouse Square and , WHEREAS, the Board has authorized the Director of General Services to enter into agreements with the private developer, Dan Beney (DBA Courthouse Square Inc.), and WHEREAS, the Board has authorized the Director of General Services to proceed with the acquisition of three parcels in the 500 block of Court Street NE which are necessary for the development of Courthouse Square, and WHEREAS, the Federal Transit Administration (FTA) has requested that the county express intent to acquire financing for its share of the project (estimated at $14 million) and to assure FTA that the county will reimburse Transit and/or FTA for federal funds used on property acquistion and other related expenses if the project is abandoned by the county, now, therefore, BE IT RESOLVED, that the Board of Commissioners hereby authorizes the County Administrative Officer to proceed with ageements and contracts for Bond Counsel and Underwriter services that will allow the county to acquire the necessary funding for our share of the Courthouse Square project BE IT FURTI~R RESOLVED, that the county recognises that federal funds, administered by FTA, and used to acquire an undivided interest in the land for the Transit District shall be reimbursed to Transit/FTA if the county abandons the project.
