RESOLUTION #98-14 <br />A RESOLUTION AUTHORIZING DEVELOPMENT AGREEMENT <br />WHEREAS, the Salem Area Mass Transit District ("District") is a transit district established <br />under ORS 267.107; is authorized to enter into intergovernmental agreements with Marion <br />County pursuant to ORS 267.200(8) and ORS 190.010; and <br />WHEREAS, the District has entered into a grant agreement with the United States Department <br />of Transportation, Federal Transit Administration pursuant to 49 USC §5309 providing for <br />federal assistance for the funding of the development of transit facilities within the scope of a <br />project known as Courthouse Square; and <br />WHEREAS, it is necessary fa the Dist~ict to enter into an agreement with Marion County for <br />the Courthouse Square project to memorialize tfie agreement between the District and Marion <br />County regarding the joint development of the Courthouse Square project; and <br />WHEREAS, the Board of Directors approved the form of an intergovernmental development <br />agreement regarding the joint development of the Courthouse Square project pursuant to <br />Resolution 97-21 adopted September 25, 1997; and <br />WHEREAS, the intergovernmental development agreement has undergone several revisions <br />since September 25, 1997, and is now ready for final approval. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE SALEM <br />AREA MASS TRANSIT DISTRICT, <br />THAT, the Intergovernmental Development Agreement, including exhibits thereto, between the <br />District and Marion County attached hereto is hereby approved; and <br />THAT, upon approval from the Federal Transit Administration, the General Manager is <br />authorized to execute the Intergovernmental Development Agreement with Marion County; and <br />THAT, John Whittington is hereby appointed to the Review Committee established pursuant to <br />the Intergovernmental Development Agreement. <br />ADOPTED by the Board of Directors on the 28th day of October 1998. <br />President, Board of Directors <br />ATTEST: <br />Secretary, Board of Directors <br />S:\61RES-ORD1R9&14 CH2 Develapment Agreement <br />Attachments <br />
