Page: 4 <br />ATTACHMENT II <br />GENERAL CONDITIONS <br />1. INTRODUCTION <br />The Salem Area Mass Transit District, hereinafter referred to as "SAMTD", and Marion <br />County, seek a contractor to provide construction laboratory testing and inspection senrices <br />related to the Courthouse Square development in Salem, Oregon. <br />2. AMBIGUITY IN SPECIFICATIONS <br />Contractor shall promptly notify, in writing, Craig Lewis, Melvin Mark Companies, phone <br />(503)223-4777, fax (503)223-4606 of any ambiguity, inconsistency, or error which they <br />discover upon examination of the Contract Documents. <br />3. COMPLIANCE WITH LOCAL/STATE/FEDERAL LAWS. RULES AND REGULATIONS <br />The Contractor shall observe and comply with all Federal, State, and local laws, ordinances, <br />regulations, and safety codes that in any manner affect the conduct of this work. The <br />Contractor shall indemnify and hold harmless Salem Area Mass Transit District/Marion <br />County and all of its officers, officials, agents, and employees against any claim, demands, <br />and causes of action of any kind or character, or any liability arising from or based upon the <br />violation of any such law, ordinance, or regulations whether by himself or his employees. <br />The Contractor shall pay the fees for and have obtained any applicable permits ~nd/or <br />licenses required by the City of Salem Ordinances or other applicable licenses and permits, <br />before starting work involved under the Contract. <br />4. INSURANCE <br />The Contractor shall not commence work under this Contract until they have furnished Salem <br />Area Mass Transit Dist~icUMarion County with satisfactory proof of the insurance specified <br />herein: <br />a. Workers' Co~ensation Insurance <br />The Contractor shall maintain, during the life of this contract, Workers' Compensation <br />Insurance or equivalent for all employees employed on this work; and shall require <br />any subcontractors to provide similar insurance for all said subcontractors' <br />employees, unless said subcontractors' employees are covered by the insurance <br />maintained by the Contractor. <br />b. ['ommercial General Liabilitv <br />The Contractor shall maintain a$1,000,000, combined single-limit, commercial <br />general liability insurance policy covering ctaims for death, bodily injury, and property <br />damage arising out of Contractor's performance, under this Contract.
