~ <br />_ ~' <br />~~ ~ <br />~ Background: ~ <br />The Salem Area Mass Transit District has assembled a committee, Public Art Advisory <br />Committee, to pursue the development of art within the Courthouse Square project. The <br />committee has requested the City contribute, through the Riverfront/Downtown Renewal <br />program, matching funds in the amount of $58,000. <br />The Downtown Development Advisory Board received and discussed the request for <br />participation in the Courthouse Square art at its meeting of May 25, 2000. The Board <br />unanimously recommended that the City Council authorize a$58,000 participation in the <br />Courthouse Square art project through the Riverfront/Downtown Urban Renewal program <br />by amending the existing construction agreement and creating a new agreement with the <br />Transit District for the art work. <br />On June 5, 2000, the above stated recommendation was presented to Ciry Council for its <br />consideration. Council referred the item to staff for additional response on three items. <br />Each item/question is addressed under facts and findings. <br />Facts and Findinas: <br />Question 1: <br />Review the overall status of City participation in the funding of all elements of the <br />Courthouse Square project. <br />Response: <br />Commencing in Fiscal Year 1997/98 through the Tax Management Plan (TMP) and <br />the annual Riverfront/Downtown Urban Renewal budget, City Council pledged up to <br />$2 million for participation in the Courthouse Square project. The types of activities <br />eligible for participation included utilities, traffic signals, streetscape, weather <br />protection, and removal of the existing transit transfer facility. City Council <br />requested that prior to establishing a participation agreement the City received <br />detailed cost estimates for the items of participation and other related information. <br />On October 12, 1998, City Council received and reviewed the requested information. <br />Council approved establishing an Intergovernmental Participation Agreement subject <br />to funding limitations on weather protection and other criteria. <br />The criteria designed by City Council to be incorporated into the agreement included <br />in part: <br />Construction elements shall be publicly bid in conformance with applicable <br />Oregon laws. <br />
