WACKER, CITY MANAGER <br />. <br />FROM: FRANK MAULDIN, PUBLIC WORKS DIRECTOR <br />~ ~ ~ <br />~ <br />SUBJECT: CTTY-INITYATED VACATION ~ <br />"~~`.'r` 7 - 1997 <br />ALLEY, BLOCK 5, SALEM <br />SALENi F,Fi~~ TFiAI~SIT <br />ISSUE: GENER~AL~ (!~lf~l~~lGER <br />Shall City Council approve the City-initiated vacation of the Alley in Block 5, Salem (see <br />Attachments A and B, map and legal description)? <br />RECOMMENDATION: <br />It is recommended City Council adopt an ordinance approving the City-initiated vacation for the <br />alley in Block 5, Salem, subject to the reservation for all public utility companies to maintain <br />and continue, repair, reconstruct, renew, replace, rebuild, or enlarge any and all faeilities in <br />said alley until such time relocation of all public utilities has been agreed upon and completed. <br />BACKGROUND: <br />On March 3, 1997, the Mayor-City Manager's Office received a Memorandum from Randy <br />Curtis, Marion County Project Coordinator for the Courthouse Square development, requesting <br />that the City initiate the vacation of the alley in Block 5, Salem (see Attachment C, memorandum <br />from Randy Curtis). The alley requested for vacation is located within the Salem downtown <br />block currently being developed as Courthouse Square. Marion Co~anty owns all the property <br />within Block 5. In the near future, Marion County and Salem Area Transit District (SATD) will <br />be executing a"purchase and sale agreement" that gives each party an undivided interest in the <br />land for development purposes. <br />On April 8, 1997, the Salem Planning Commission voted to recommend Council approve the <br />proposed vacation request (see attachment D). <br />
