Performance and Payment Bonds Use Marion County's forms, a copy of which is attached to these Special Provisions; a surety's standard performance bond form will not be acceptable. Restrictions on Commencement of Work Until the County sends the Contractor written notice to proceed with the work and a preconstruction conference has been held, the Contractor shall not have authority to go on the property on which the work is to be done or to move materials, equipment or workers onto that property. The Contractor will not be entitled to extra compensation because the commencement or work is delayed by failure of the County to send the contract documents for execution. However, if more than 10 calendar days elapse between the date the proposal is opened and the date the County sends the contract documents to the Contractor to be executed, the Contractor may apply for an adjustment of contract time according to 00180.80(b). Notice to Proceed The notice to proceed will consist of a fully executed contract sent by the County to the Contractor. The Contractor will not be entitled to extra compensation because the commencement of work is delayed by failure of the County to send the notice to proceed. However, if more than 21 calendar days elapse between the date the County receives from the Contractor the executed contract together with the other required documents and the date the County sends the notice to proceed, the Contractor may apply for an adjustment of contract time according to 00180.80(b). Final Trimming and Cleanup The project shall not be regarded as complete until clean up has been entirely finished and the assessment of liquidated damages will be made accordingly. Clean up shall accompany the progress of the work as nearly as practical.
