complied with all prescribed public bidding procedures and <br />requirements, and who has not been disqualified by the State of <br />Oregon. <br />Performance and Payment Bonds <br />Use Marion County's forms, a copy of which is attached to these <br />Special Provisions; a surety's standard performance bond form <br />will not be acceptable. <br />Restrictions on Commencement of Work <br />Until the County sends the Contractor written notice to proceed <br />with the work and a preconstruction conference has been held, the <br />Contractor shall not have authority to go on the property on <br />which the work is to be done or to move materials, equipment or <br />workers onto that property. <br />The Contractor will not be entitled to extra compensation because <br />the commencement or work is delayed by failure of the County to <br />send the contract documents for execution. However, if more than <br />10 calendar days elapse between the date the proposal is opened <br />and the date the County sends the contract documents to the <br />Contractor to be executed, the Contractor may apply for an <br />adjustment of contract time according to 00180.80(b). <br />Notice to Proceed <br />The notice to proceed will consist of a fully executed contract <br />sent by the County to the Contractor. <br />The Contractor will not be entitled to extra compensation because <br />the commencement of work is delayed by failure of the County to <br />send the notice to proceed. However, if more than 21 calendar <br />days elapse between the date the County receives from the <br />Contractor the executed contract together with the other required <br />documents and the date the County sends the notice to proceed, <br />the Contractor may apply for an adjustment of contract time <br />according to 00180.80(b). <br />Final Trimming and Cleanup <br />The project shall not be regarded as complete until clean up has <br />been entirely finished and the assessment of liquidated damages <br />will be made accordingly. Clean up shall accompany the progress <br />of the work as nearly as practical. <br />
