Chaptcr 4: tvlc[hods of Selection <br />http://wwN~.fta.doi.go~~%fta'7ibraryiadmin/BPPman~sect 40.htm <br />• 25% price-differential waiver - This waiver67 requires a deternunation by the FTA Administrator <br />that the inclusion of a domestic item or domestic material will increase the cost of the contract <br />between the grantee and its supplier of that item or material by more than 25 percent. <br />• Rolling stock waiver - The requirement is waived for the procurement of buses and other rolling <br />stock (including train control, communication, and traction power equipment), if the cost of <br />components produced in the United States is more than 60 percent of the cost of all components <br />and final assembly takes place in the United States.68 There are very detailed rules relating to <br />components and domestic content of those components contained in 49 CFR § 661.11 that are <br />background for this waiver.~~ <br />Who applies for the waivers? How are waivers processed? When should they be applied for? <br />• If a"Public Interest" waiver has been granted, no individual application for a waiver is required. <br />Generally, only grantees may apply for.a waiver.~l However, if an offeror is seeking a waiver under <br />§ 661.7(~[waiver for component or sub-component under rolling stock procurementsJ or <br />§ 661.7(g)[waiver for specific item or material that is used in the production of a manufactured <br />product that is governed by the requirements of § 661(d)], the FTA will consider a request for <br />waiver directly from the offeror or supplier.72 <br />Applications for waivers are processed in accordance with the provisions of 49 CFR § 661.9. Except as <br />noted above, the waiver must be obtained "in a timely manner" through the grantee. The grantee's request <br />for waiver must be made in writing, include all facts and justification to support the waiver, and be <br />submitted to the FTA Administrator through the appropriate FTA Regional Office.
