c. Procwernent ~y Sealed Bids/Invitation For Bid lIFB). Bids are publicly solicited and a fum-fixed-price contract (lump sum <br />or unit price) is awerded to the responsible bidder whose bid, conforming with all the material terms end conditions of the <br />invitation for bids, is the lowest in price. • <br />(1) in order for sealed bidding to be feasible, the following conditions should be present: <br />(e) A complete, adequate, and realistic spxification or purchase description is available; <br />(b) Two or more responsible bidders are willing and able to competc effectively for the business; <br />(c) The procurement lends itself to a firm fixed price contract and the selection of the successful bidder can be made <br />principally on the basis of price. <br />(d) No discussion with bidders is neodad. <br />(2) If this procurcment method is usod, the following requiramenis apply: <br />(a) The invitarion for bids will be publicly advatisad and bids shall be solicitod from an adequate number of known suppliers, <br />providing them sufficient time to prepare bids prior to the date set for opening the bids; <br />(b) The invitation for bids, which will include any specifications end pertintnt attachments, shall define the items or services <br />sought in order for the bidder to properly respond; <br />(c) All bids will be publicly opened at the time and place prescribed in the invitation for bids; <br />(d) A fum 5xed-price contract award will be mad~e in writing to the lowest responsive and responsible bidder. When specified <br />in bidding doaat~ents, factars such as discounts, transportation costs, and life cycle costs shall be considered in determining <br />which bid is lowest; <br />Payment disc~auits will only be used to detainine the low bid when prior experience indicates that such discounts are usually <br />taken advantage of; end <br />(e) Any or all bids may be rejected if there is a sound documented business rcason. <br />(3) The sealed bid method is the prefat~ed mahod far praaaing oonsh~wtian if the conditions in paragraph 9c(1) above apply. <br />d. Procurement By Competitive PronosaUReguest for Pronosals (RFPI. The competitive proposal method of procurement <br />is nonnally oonduded with more then aie saurce s~ibmitting an o$er i.e., prc~osai. Either a fixed price or cost reimbursement <br />type contract is awarded. This method of procurement is generally u9od whtn conditions are not appropriate for the use of <br />sealed bids. If this procurement method is used the following requireEnents apply: <br />(1) R~s for proposals will be publicized. All evaluation factors will be identified along with their relative importance. <br />(2) Proposals will be solicitod from an edequate number of qualified souroes. <br />(3) Grantees will have a method in placx for conducting technical evaluatia~s of the proposals received and for sclecting <br />awardces. <br />(4) Awerds will be made W the responsible fum whose proposal is most advantageous to the grantee's program with price <br />and other factors considered <br />e. ~ta~tr~nt Of Archita~tu~al and F.n~g Setvices fA&E). Grantees shaU use competitive proposal procedures based <br />on the Brooks Ad when contracting for A&E a~rvicxs as defined in 40 U.S.C. Sec.167;541. Other types of services <br />considered A&E services -include program managemeat, c~~struction management, feasibility studies, preliminary <br />~8~~8, ~~ ~'~8, mapping, and setvices which require performance by a registered or licensed erchitect or <br />engineer. <br />
