7. Reimbursement P~ment - Limitations <br />a. Agency shall pay to the County and Transit District the actual cost <br />for construction, inclusive of any change order(s) for the specific areas of Agency <br />participation designated in Section 1. <br />b. Payment shall be made by the Agency to the County and Transit <br />District as reimbursement for work completed and paid to the contractor by the County <br />and Transit District. Payment requests shall be submitted to the Agency as progress <br />payments for work completed during the construction. All payment requests submitted <br />to the Agency shall include a statement of the work performed with unit quantities and <br />cost, statement of Project architect/engineer certifying the work was performed and a <br />certification of the County and Transit District that the amount requested for <br />reimbursement has been paid to the contractor. Payment will be made by the Agency <br />to the County and Transit District within thirty (30) days of submission of a completed <br />payment request. <br />c. Agency participation and payment for weather protection shall be <br />limited to an amount not to exceed one hundred sixty dollars ($160.00) per lineal foot <br />of the weather protection, as measured in an alignment parallel to the public right of <br />way. <br />d. Total Agency participation payment to the County and Transit <br />District for construction reimbursement and architectural/engineering fees provided <br />under this Agreement shall not exceed the total sum of $2 million. <br />8. Phasing Streetscape Improvement Chemeketa Street <br />The County and Transit District intend to offer, for development by a third party, <br />a teasehold interest in the Project land fronting Chemeketa Street. Timing of such third <br />party development is anticipated to preclude construction of streetscape improvements <br />within the Chemeketa Street right of way concurrent with the remainder of the Project <br />streetscape construction. To facilitate construction of streetscape improvements within <br />Chemeketa Street right of way independent of the remaining three block faces of the <br />Project, the County and Transit District shall: <br />a. Prepare plans, specifications and bid documents in such manner <br />that the streetscape improvements within Chemeketa Street right of way may be bid <br />and the construction contract awarded independently of the other three block faces of <br />the Project streetscape. Chemeketa Street streetscape plans, specifications, bid <br />documents, bid award, reimbursement payment and architectural/engineering fees shall <br />be subject to the procedures and limitations of Sections 1 through 6 of this Agreement. <br />5 <br />
