The removal of the on-street facility is an item that could be reimbursed through streetscape urban renewal funds. An option might be to amend the streetscape agreement and have the city provide the engineering services using Westech, their engineer of record for this portion. We could also review the city's current agreement with Westech to see if there is a provision that other government entities could contract their services at the same rates and enter into our own agreement with them. Unless Mike has some other thoughts, we probably should see if we can get a copy of the city's agreement with Westech for a quick review. This agreement is also specific that all items subject to their participation shall be publicly bid for construction award in conformance with public improvement bidding requirements per state/federal laws. A quick check on Pence/Kelly's agreement didn't show that this work was included in our original bid documents. I agree with David that we need to bid this. I'll have to confirm this with Peggy. As to obtaining a contractor to do the work, my initial response would be that a separate selection process should be used because this project does not appear to be within Pence/Kelly's scope of work for courthouse square. Unless someone can show me that it is, a new bid and specifications need to be prepared to issue a call for bids for the existing mall project. Again, I'll confirm with Peggy. The city estimates that cost will range from $100,000 to 268,000 $depending on options. The transit district is currently exploring the question as to whether FTA has a role in the procurement process. Ether way, the transit district has limited experience in coordinating this type of public improvement. For this reason, I would like to explore the option that the county take the lead role in hiring the consultants and bidding the project. Westech Engineering is currently a subcontractor of Arcbuckle Costic on the Courthouse Square project. They are also the City's engineer of record on streetscape projects. What steps are involved and what are the issues related to sole sourcing the engineering work & project management to Westech? Competitive Bids would still be required for actual construction although Pence Kelly has expressed an interest in the project if we would consider extending their current contract. CC: Billy Wasson
