The removal of the on-street facility is an item that could be reimbursed <br />through streetscape urban renewal funds. An option might be to amend the streetscape agreement and <br />have the city provide the engineering services using Westech, their engineer of record for this portion. <br />We could also review the city's current agreement with Westech to see if there is a provision that other <br />government entities could contract their services at the same rates and enter into our own agreement with <br />them. Unless Mike has some other thoughts, we probably should see if we can get a copy of the city's <br />agreement with Westech for a quick review. <br />This agreement is also specific that all items subject to their participation shall be publicly bid for <br />construction award in conformance with public improvement bidding requirements per state/federal laws. <br />A quick check on Pence/Kelly's agreement didn't show that this work was included in our original bid <br />documents. <br />I agree with David that we need to bid this. <br />Thanks, <br />Peg <br />»> DAVID HARTWIG 07/20 4:37 PM »> <br />If removal and restoration of the existing transit mall is part of the streetscape project, and Westech is the <br />city's engineer for streetscape, it may be possible for Marion County to contracfi with Westech, if they will <br />offer the county the same contract terms as they have with the city. I'll have to confirm this with Peggy. <br />As to obtaining a contractor to do the work, my initial response would be that a separate selection process <br />should be used because this project does not appear to be within Pence/Kelly's scope of work for <br />courthouse square. Unless someone can show me that it is, a new bid and specifications need to be <br />prepared to issue a call for bids for the existing mall project. The city estimates that cost will range from $100,000 to <br />268,000 $depending on options. <br />The transit district is currently exploring the question as to whether FTA has a role in the procurement <br />process. Ether way, the transit district has limited experience in coordinating this type of public <br />improvement. For this reason, I would like to explore the option that the county take the lead role in hiring <br />the consultants and bidding the project. <br />Westech Engineering is currently a subcontractor of Arcbuckle Costic on the Courthouse Square project. <br />They are also the City's engineer of record on streetscape projects. What steps are involved and what are <br />the issues related to sole sourcing the engineering work & project management to Westech? <br />Competitive Bids would still be required for actual construction although Pence Kelly has expressed an <br />interest in the project if we would consider extending their current contract. <br />CC: Billy Wasson <br />
