These final scores and rankings within each <br />criteria will again be arrayed by the Selection Committee and considered according to <br />the relative degrees of importance of the criteria defined in "Proposal Evaluation <br />Criteria" (Section 6.3(b)). <br />The Selection Committee will then recommend to the Procuring Agency that proposal <br />which it ~nds to be most advantageous to the Procuring Agency based upon the <br />evaluation criteria. Any such selection of a proposal by a responsible Proposer shall be <br />made by consideration of only the criteria of "Qualification Requirements" (Section <br />6.3(a)) and "Proposal Evaluation Criteria" (Section 6.3(b) ) above. The results of the <br />evaluations and the selection of a proposal for any award will be documented in a report. <br />The Selection Committee reserves the right to make a recommendation of a proposal it <br />judges to be most advantageous to the Procuring Agency based upon the evaluation <br />criteria, without conducting any written or oral discussions with any Proposers or <br />solicitation of any BAFOs. <br />(g) Press Releases. The Procuring Agency will make a public announcement of the award. <br />No public announcement or press release relating to the subject matter of this RFP shall <br />be made by a Proposer without the priar written approval of the Procuring Agency. <br />LEASE <br />The successful Proposer shall enter into the Ground Lease agreement in the form attached <br />hereto, which shall be completed with the terms of the Business Offer and other relevant <br />portions of the proposal accepted by the Procuring Agency. <br />OTHER REQUIREMENTS <br />8.1 All facts and opinions stated within this RFP, and all supporting documents and <br />data, are based on information available from a variety of sources. No representation or <br />warranty is made with respect thereto. <br />8.2 The Procuring Agency will not modify the selection process or other aspects of this <br />offering. <br />8.3 The Procuring Agency reserves the right to waive minar irregularities and accept <br />proposals with minor deviations from the requirements herein. The Procuring Agency <br />also reserves the right to reject all submittals in response to this RFP, without cause. <br />8.4 The Procuring Agency retains the sole responsibility to determine timing, <br />arrangement, and method of proposal presentations throughout the developer selection <br />process. <br />PROTESTS <br />9. 1 Proposers may submit a written protest or request for change of particular solicitation <br />provision, specification, or contract terms and conditions to the Procuring Agency no <br />later than seven (7) calendar days prior to close of the solicitation. The Proposer shall <br />submit in writing the reasons for the protest or request and any proposed changes to the <br />solicitation provision, specification, or contract terms and conditions. The Procuring <br />Agency will not consider a solicitation protest submitted after the deadline established in <br />this RFP. <br />
