We (the County) have reviewed certain conditions as requested by Nancy. <br />Whfle we have responded to her and oerr 6ond counsel, Ed Einowski, I would like to take this opportunity to a~rm our <br />position on the items outlined below: <br />1. Constructlon contracts have no1 been executed yet. The county will include requirements ~or ~~ ents nas <br />performance bonds. Oregon law requires this. The county wil! also include liquidated dama es aym <br />requested. <br />Z. Marion Counry has completed the Phase I environmental assessment jor the entire Project site some time ago. <br />Thrs information rs available upon request. The work the county has dorre is as follows: Phases 1 and II, a workplan, <br />completion of al! worl~ frnal reports to DEQ on work done, and further delineation as requested by DEQ. A11 work <br />requested by DEQ has been ftnished. DEQ has accepted by the Pr~oject design. The county has requested letters of <br />No FurtherAction jrom DEQ. The county is awa~ting DEQ's response. <br />3.
