An opinion of Bond Counsel that the condominium interest in the County share of the <br />Courthouse Square Project will not adversely affect the rights and remedies of the Trustee as <br />assignor of the Lease and will not hinder the exercise of such remedies as may be available to the <br />Trustee under the financing documents including, but not limited to, the remedy of eviction and <br />re-lease of the Project. <br />11. Construction contracts must include the requirement for payment and performance <br />bonds in the amount of the contract. In addition, provision for liquidated damage payments as a <br />result of delayed construction completion must also be included in the construction contracts. <br />12. Completion and MBIA review of the Phase I environmental site assessment of the <br />Project site. <br />13.
