~...- ~..r~ <br />Samuel Crowell <br />563 Court Street #1 <br />Salem, OR 97301 <br />March 5, 1997 <br />Sent Certified and First Class <br />Daniel Berry <br />Prudential-Bache <br />340 Vista Ave S.E. <br />Salem, OR 97302 <br />Re: Eviction Proceedinas <br />Daniel Berry: <br />This letter is in response to Ms. Andrews recent letter <br />(dated 2/26/97) concerning eviction proceedings at 563 Court <br />Street, N.E., Salem. Ms. Andrews letter contains certain factual <br />matters that were either incorrect or misleading and I am taking <br />this opportunity to clarify the facts of our negotiations. Ms. <br />Andrews can verify all statements I further discuss, as she is the <br />person with whom I dealt. Also, in an effort of my continued good <br />faith in negotiating, and a desire to settle this matter as <br />expeditiously as possible, I would like to propose a solution that <br />may obfuscate the need for further consideration of the <br />contractual matter at issue. <br />Beginning February 13, 1997 the following occurred. I met <br />with Daniel Berry, Ms. Andrews, and a consultant, whose name I do <br />not recall. We discussed my eviction from 563 Court St. N.E. and <br />my rights under The Uniform Relocation Assistance and Real <br />Property Acquisition Act (42 U.S.C. 4601, et seq.). On Monday, <br />February 17, 1997, Ms. Andrews returned to my apartment and <br />offered the $295.00 comparable unit. I asked her if I could have <br />the unit at $365.00. She stated that I could. No cond.itions were <br />placed on this oral contract with the exception that I was not to <br />communicate with the other tenants regarding the terms of our <br />agreement (a promise which I have kept). She stated that the <br />terms of the deal were acceptable and filled in the forms <br />accordingly. Neither she nor I understood all the forms <br />completely, so we did not sign them on that date. Ms. Andrews <br />later called me that day and retracted her promise, then stating <br />that she should have checked with Mr. Berry before making the <br />agreement (Mr. Berry's acceptance was not a condition expressed to <br />me in the initial agreement with Ms. Andrews). I told her that I <br />was not happy that the agreement was being rescinded. <br />1 <br />
