B4~Y Marion County agrees to pay Contrador for fhe following services: Toaoaraahic survey of Block 5 Salem o rt use Sauare Proiect to include 1' contours of excavated areas and calculations of the cubic yards of,excavation. The Contractor agrees to perform these services for the period of July 13, 1998, to August 39, 1999. The C~ agrees to pay to Contracto~ at the rate of $90.00 pe~ hour for 2 man survey crew, autocad services ~$48.00 per and registered surveyor @$68.00 per hour for these services. The sum of $2,350.0'6 is the maximum amount obii~ by the County for the identified services under fhis agreemerrt. 1. Payment to Contractor wi8 be made upon receipt of invoice in accoMance Ith the current Mario ~ policies and procedures. - • / ~ ~~ 2. The order for services is to be initiated by Marion Courrty. 3. The Cont~actor agrees to defend, indemnify and hold harmless the County, its o rs, agents, and employees from damages arising out of the tortious acts of the Contractor, its officers, agents, and em loyees ading within the scope of their employment and duties in pertormance of this agreement subject to the limitations and conditions of the Oregan Tort Claims Act, ORS 30,260 through 30.300, and the Oregon Constitution, ArtJcle XI, Section 7. 4. 7he Contractor shall carty liability and property damage/badily injury automobile insurance, workers' compensation insurance, and if applicable equipment insurance. 5. The County, pursuant to applicatile provisions of ORS 30.260 to 30,300, mairrtains a self-insurance program which provides property damage and personal injury coverage. 6. This agreement is dependent upon availability of funding. 7. The Contractor agrees to comply with the Civil Rights Act of 1964, and 1991, and Section 504 of the Rehabititation Act of 1973 as implemented by 45 CFR 84.4 which states in part, "No qualified person shall on the basis of handicap be excluded from participation in, be denied the benefits of, or otherwise be subjected to discrimination under any program or activity which received or benefits from federal financial assistance," and Americans with Disabilities Act of 1990. The Confractor also agrees to comply with the applicable provisions of ORS 279.316. 8. This contract may be terminated with or without cause with 30 day's written notice by either party and delivered by certified mail.
