Since we are a public agency and probably <br />will not sell, the risks are different. Counry dces not want to discount the pos:~ibility to spend <br />$40,000 and if that is all I'll spend. If you have to vent, you will have a need for long term <br />remediation at a cost of $120,000-200,000. You need to weigh the economics and enough evidence <br />to say we would not need to go on with some sort of treatment system. <br />What was the recommendation based on the meeting with county last Friday? They were also of <br />the opinion that we should only go down to 16 feet. Randy would like to involve Mike Hansen, <br />Marion County Legal Council in any further discussions. Additional discussion was held about costs <br />to dig completely out and backfill as well as costs involved in remediation if Leonard has to <br />accommodate in the design, putting the system in, plus all consulting costs and DEQ time. Kathleen <br />said the likelihood of a requirement to put in a system is 20/25%. She thinks they'll let us cap it, <br />making sure we know what is in it and if we can prove it is stable and not going anywhere. How <br />long do we monitor and how much? If we don't get closure now what will it cost ~nd how dces it <br />compare in cost to removing now? It has been calculated in each scenario. Monitoring will be for <br />more than one year, but closer to 3 years on the site. It is still unknown and there is a 25 % chance <br />we may not need to do it. We can't pin DEQ down to a commitment. They won't tell you it is <br />either one or the other. We are putting together a work plan that is brief and in writing and the DEQ <br />will respond. The work plan will include monitoring for three years. After their review, they can <br />provide feedback at that point. <br />Kathleen said they found "perk° (cleaning solvent used in printers/dry cleaners) in xhe groundwater <br />~ that is causing problems now. We need to know what our options and costs are and then make a <br />decision. With either two proposals, there will be at least three yeazs of monitoring two wells, but we <br />will propose four wells. Why can't DEQ tell you now and at what point would that be made <br />known? We need to have a plan that requires closure on the site. The hearing process is 30 days. <br />We don't have to submit an Corrective Action plan, but the DEQ can request information from vazious <br />places. When we were having discussions a Conective Action plan was not discussed. Bruce was <br />asked to write a simple work plan time frame proposing closure. If you need a lot more assurances <br />from DEQ, then we can write a Corrective Action plan, make it available for public feedback and then <br />the DEQ can respond to it. <br />Additional discussion ensued regarding what information was needed for county to make a decision. It <br />is possible that the building could be built then find out that a venting system would be required. NFA <br />letters from the DEQ are conditional and from this point on, they can come back to you with requests <br />that would affect the site. In trying to provide you with the assurances you want, it may not be there. <br />If down the road something points back to Marion County, the DEQ will pursue it. Groundwater rules <br />will apply no matter what we do. <br />We need to have a conference call between Randy, Mike Hansen, Dan and Kathleen. Since legal has <br />been giving guidance to Kathleen, they need to be included in these discussions. W~ aze all a little <br />uncomfortable with DEQ and don't fully understand what they can do to us. It is unknown what <br />motivates DEQ down certain paths and why. Our concern is that we are treated the same as the <br />Statesman Journal. Since SJ is ahead of us, if they get answers that will help us with our decisions <br />that would be to our advantage. Kathleen said their consultant has agreed to exchange information. It <br />appears that there are similar stories on each side of the street.
