Up unt~'1 tf~is meeting, the respedive policy <br />bodies had not been involved in the development of the ooncept The meeting was welt attended by <br />represenfatives from the commu~it~r and bus'a~ess. indud'mg Dan Be~def a~d John Henrickso~ of the <br />Statesman Joumal. and was fi~lly reported in the medra the fdlowing day. <br />November 09,1995 <br />' The Transit Board held an open public woric sessio~ witfi statf im which Patrick Heam, Exeaitive <br />Di~ector af the Govemme~t Standards and Pradioes CoRUrussio~ made a presentation reganding <br />Board etti~cs. This session was set by Anderse~rWydcoff in October as part of the Boarci's Team <br />' Bu~d'mg program. Mr. Heam e~lamed what oa~sti4~ted a'potential oo~flid of interesY' and a~ acbual <br />"conflict of art~ and what steps Board membe~s rtwst take to avdd violating SNate law i~ fhis r+egaod. <br />~ <br />' <br />~ <br />~ <br />' <br />~ <br />r <br />' <br />' <br />~ <br />November 30,1995 <br />The Transit Board met in regular open publ'~c session to dis~ss designatio~ of the Senator Blodc as the <br />p~+efened site for the ~ew Do~mtown Trdnsit Ce~ter. "For the ~rci, Oire~ctor Frey stated that he <br />has a cor~flict-of-interest with regard to this discussion, and will refrain from d'~scussion and <br />voting. He has a real estate property listed on the Senator Block. The motion camed 4-0 by <br />Roll Call vote with Director Frey abstai~i~g (Director 8errey not present)." Onoe the Board had <br />designated the site for the projed. the Board also acted to: Fsdorse fhe Cou~house Square conoep~ <br />To ~age the OistricYs sister age~aes to likewise embFaoe the Courthouse Square concep~ and, <br />To request a 3 year moratorium on moving tlie H'~ Str~eet Traru~ Facdity. The motions carried <br />unanimaasly. M~ Frey did ~ot abstain on these issues because they wEr~ r~ot to the hea~t of the <br />issue of acqui~ng the Senator Block; and M~. Bemey was ~ot pr+esent. <br />Oecember 1995 <br />Andersen-Wydcoff became aware of M~. BeR'ey's pote~l inte~st ai becoming the developer of <br />Cou~thouse Square and met with Pahick Heam to d'~scxiss the oonflid of inte~est that fhis would ra~se. <br />Mr. Heam neiterated his comme~ts made at the wotlc session with the Transit Boand in November. <br />say'~ng that as long as M~ BeRey publidy dedared his co~lict of i~ter+est and did nat participate <br />in the discussion or votes related to the project tfiat he would not be in violation of State ethics <br />law. He indicated that M~. Bert'e~s ootiflid was drff~+e~tt from NIr. F~/s in fftat tNr. F~s oonflict had <br />to do only with a listing of a piece of propetiy which the Camty weuld have to aoqui~e for the projed, but <br />Mr. BeReys conflict arose from the project itsetf and, t~+efot+e. fhe enfinety of fhe pr+ojed. He furifi~ <br />indicated that altliough following the e~ias laws would assure that no oo~flict of ~te~est did ocax. that <br />woutd not predude a potential for the public peroeptio~ of a oonflici and the pditical questa~s tliat m~ght <br />raise. He also said tlzat it would be best if M~. F~,~ abstauied o~ al1 i.s~sues ~+elated to fhe final aoquisrtion <br />of fhe site instead of just those related to acquis~tion of 1he properiy he had listed.
