Incorporation of Federal Transit Administration (FTA) Terms The 37 provisions of this Addendum include, in part, certain Standard Terms and Conditions 38 required bv DOT, whether or not expresslv set forth in the preceding contract provisions 39 All contractua( provisions required bv DOT, as set forth in FTA Circular 4220 1 D dated 40 April 15, 1996, are herebv incorporated by reference. Anvthing to the contrarv herein 41 notwithstandina, all FTA mandated terms shall be deemed to control in the event of a 42 conflict with other provisions contained in this A~reement The Contractor shall not 43 perform anv act, fail or perform anv act, or refuse to comp(v with anv Recipient requests 44 which would cause Recipient to be in violation of the FTA terms and conditions. 4. Federal Changes. Contractor sha(1 at all times complv with all applicable 4 FTA regulations, policies, procedures and directives, including without (imitation those 47 listed directlv or bv reference in the Agreement (Form FT~ MA (3) dated October 1, 1996) 48 between Recipient and FTA, as thev mav be amended or promulgated from time to time 49 durin~ the term of this Contract. Contractor's failure to so comp(v shall constitute a 50 material breach of this Contract. ~ 1 5. Energy Conservation. The Contractor agrees to compty ~vith mandatorv ~2 standards and policies relatina to energv efficiencv which are contained in the state enerw 53 conservation ptan issued in compliance with the Ener~y Policv and Conservation Act ~4 6. Recovered Materials. The Contractor agrees to complv ~vith all the ~~ requirements of Section 6002 of the Resource Conservation and Recoverv Act (RCRA) as 56 amended (42 U.S.C. 6962), inctudin~ but not limited to the regulatorv provisions of 40 57 C.F.R. Part 247, and Executive Order 12873, as thev appl~~ to the procurement of the items 58 desiQnated in Subpart B of 40 C.F.R. Part 247. ~9 7. Ci~~il Riahts.
