SUPPLEMENTAL PROVISIONS <br />The following supplements modify, change, delete from or add to AIA Docume t B 141, Standard <br />~ Form of Agreement Between Owner and Architect (1987 Edition). Where any rticle, Paragraph, <br />Subparagraph or Clause of the B 141 form is modified, changed, deleted from or dded to by these <br />Supplemental Provisions, the unaltered provisions of that Article, Paragraph, Subparagr ph or Clause shall <br />remain in effect. Where any part of the B 141 form is in conflict with these Supplement 1 Provisions, these <br />Supplemental Provisions shall govern. Where any part of the B 141 form or th se Supplemental <br />Provisions are in conflict with the FTA Addendum , the FTA contract requirements shal govern. <br />1.1.0 The Owner and Architect acknowledge and agree that the Architect com enced performing <br />design services for this Project on , 19 , on behalf of the O ner. The parties <br />agree that this Agreement relates back to the time of commencement of the Architect s services for this <br />Project and supersedes the above agreement. <br />1.1.2.1 The Architect shall provide to the best of its ability services under t is Agreement in <br />conformance with the detailed schedule for the Architect's services prepared by he Architect and <br />approved by the Owner pursuant to Subparagraph 1.1.2. <br />1.1.4 The Architect warrants that it is licensed to perform architectural services in t e state of Oregon <br />and that it or the parties or persons that perform engineering services under this Agree ent are licensed to <br />perform engineering services in the state of Oregon. <br />1.1.5 The Architect and its consultants shall perform all services under this Agre ment in a manner <br />consistent with the degree of care and skill ordinarily and customarily exercised by me bers of the same <br />profession currently practicing under similar circumstances. <br />1.1.6 The Architect and its consultants shall comply with applicable federal, sta e, and local laws, <br />statutes, codes, rules, regulations, and orders in performing the Architect's obli ations undec this <br />Agreement. <br />~ 1.1.7 The Owner reserves the right to enter into additional agreements with third parties to perform <br />architectural and engineering services related to the Project. The Owner further re erves the right to <br />terminate certain of the Architect's obligations under this Agreement and to perfor such obligations <br />itself or to enter into agreements with third parties to perform such obligations. In th event the Owner <br />terminates certain of the Architect's obligations pursuant to this Subparagrap , the Architect's <br />compensation under this Agreement shall be equitably adjusted. <br />2.2.4.1 The Schematic Design Documents shall comply with applicable laws, st tutes, ordinances, <br />codes, orders, rules and regulations. <br />2.3.1.1 The Design Development Documents shall comply with applicable laws, s atutes, ordinances, <br />codes, orders, rules and regulations. <br />2.4.1.1 The Construction Documents shall comply with applicable laws, statutes, ordinances, codes, <br />orders, rules and regulations. <br />2.4.5 Unless directed by the Owner otherwise, the Architect shall also prepare the final Drawings on <br />computer-aided design disks. <br />2.4.6 The Owner's review and approval of the Schematic Design Documents, the D sign Development <br />Documents and the Drawings and Specifications (both preliminary and final) dur ng the Schematic <br />Design Phase, Design Development Phase or Construction Documents Phase, or at an other time, shall <br />not relieve the Architect of its responsibilities for the final Drawings and Specifications. <br />Courthouse Square Project <br />~: Architect Agreement Supplemental Provisions <br />Page - 1 <br />
