Monthly reports within twenty (20) days after the end of each calendar month, setting <br />forth: (a) disbursements made during such month and for the yeaz to date and (b) a comparison <br />with the Project Budget for such month and for the year to date. <br />7.7 Notifications to Owner <br />Developer shall notify Owner promptly of any information received by Developer with <br />respect to any proposed zoning changes, condemnation proceedings, environmental actions or <br />laws, request for easements, leasing or sales proposals, and such other matters as may be of <br />interest to Owner, together with any recommendations Developer may have with respect to such <br />matters and an estimate of the time available to Owner to consider such information before a <br />response thereto is, in the reasonable judgment of Developer, required to be made. <br />SECTION S INDENINITY AND INSUR.ANCE <br />8.1 Subject to the terms of indemnification in Exhibit , Developer agrees to defend, <br />indemnify, and hold Owner hatmless from any loss, damage, liability or injury arising out <br />of Developer's negligence, willful misconduct, or breach of this Agreement, except to the <br />extent caused by the negligence or willful misconduct of Owner. <br />8.2 Developer agrees to provide insurance during the term of this Agreement as follows: <br />8.2.1 COMNIERCIAL AND AUTOMOBILE LIABILITY <br />1. Commercial General Liability insurance "occurrence" form including personal <br />injury with a$1,000,000 (per occurrence) combined single limit bodily injury, <br />including personal injury and property damage, and a$2,000,000 products and <br />~,,, completed operations and general annual aggregate limit. The insurance policy <br />shall be endorsed to apply the aggregate limits of the policy independently to this <br />
