Downtown Development Board <br />Page 2 <br />• The development that occurs on the property is required to be, in part, "transit- <br />supportive." There are no precise definitions, but we do know that such uses as retail, <br />housing, day care, and food services are generally considered to be transit-supportive. <br />• Depending on the timing of the private development, as well as pending current design <br />decisions by the County and District, the private partner ~ have an opportunity to <br />aca,uire as many as 66 parking spaces in the underground structure. The additional <br />spaces will be an add-alternate to the project bid package. <br />• Land lease fees collected from the private partner will be divided between the County <br />and District proportionally. The revenue can be used to reduce public costs by <br />offsetting operating costs of the Courthouse Square facilities. <br />• The private developer will have the option of having their ground-level spaces open <br />onto the transit mall, as well as the Chemeketa St. frontage. <br />• The streetscape budget includes funding for the Chemeketa St. frontage. Depending <br />on the design and timing of the private development, we may seek a future amendment <br />to the budget package we are submitting to you today, to accommodate the timing and <br />final design of the private development.. <br />• The private developer will be a party to a land lease agreement, with the County and <br />District, which will specify such conditions as building design features, allowed uses, <br />and other design considerations. This agreement will be subject to approval by each <br />party, and by the Federal Transit Administration. <br />As a footnote on one other condition posed by the City, relative to obtaining a favorable <br />legal opinion about the Council's ability to exercise urban renewal levy authority: we <br />believe that the passage of Measure 50 has rendered this condition moot. However, City <br />staff have indicated that they are pursuing this question with the City Attorney, and that <br />this issue will be resolved prior to any Council action on streetscape funding. <br />
