I ~ ,~ 1 If any Certificates are not presented for payment at the date fixed for their repayment, or if ~2 any Certificates are not presented for payment when due, and if funds sufficient fo such prepayment 3 or payment are held by the Trustee, the holders of such Certificates will there fter be restricted 4 exclusively to such funds for the satisfaction of any claim relating to such Certific tes. The Trustee 5 shall hold such funds (without liability to the holders of the Certificates for interes thereon after the 6 prepayment or payment date) and other funds as established hereunder and then u der the Trustee's 7 control until required by applicable escheat laws to deliver such moneys in acc rdance with said s escheat laws and thereafter the holders of such Certificates or coupons shall b subject to such 9 escheat laws. 10 11 SECTION 208. ADDITIONAL CERTIFICATES; OTHER INDEBTEDNESS O COUNTY. 12 13 (A) ADDITIONAL CERTIFICATES. Subject only to the conditions, restrictio s and limitations 14 set forth in this Section 208, the County reserves the right to direct the Trustee to e ecute and deliver 15 Additional Certificates in one or more series for one or more of the following pu oses: 16 1 ~ (1) to provide funds sufficient to pay the County's Share o completing the 18 Courthouse Square Project in accordance with the original plans and speci ications therefor, 19 plus any Costs of Issuance incurred in connection therewith (any Addi 'onal Certificates 20 executed and delivered for such purpose being herein called "Completio Certificates"); 21 ~ 22 (2) to refund all or any portion of the Outstanding Certificates, lus any Costs of ~,,3 Issuance incurred in connection therewith (any Additional Certifica es executed and 24 delivered for such purpose being herein called "Refunding Certificates")• or 25 26 (3) following completion of the Courthouse Square Project in ac ordance with the 27 original plans and specifications therefor, to provide funds sufficient to ay the County's 28 Share of Improvements to the County Facilities, plus any Costs of Iss ance incurred in 29 connection therewith (any Additional Certificates executed and delivere for such purpose 3o being herein called "Improvement Certificates"). I 31 ~ 32 (B) REFUNDING CERTIFICATES. In the event that Refunding Certificates re to be executed 33 and delivered to refund less than all Outstanding Certificates, the County may not ~ lirect the issuance 34 of such Refunding Certificates, and the Trustee shall not execute and delive such Refunding 35 Certificates, unless the aggregate amount of principal and interest scheduled to b due and payable 36 with respect to such Refunding Certificates in each Fiscal Year does not exceed by more than $5,000 37 the principal and interest scheduled to be due and payable in the same Fiscal Year 'th respect to the 38 Certificates being refunded. The limitation set forth in this Section 208(C) shal not apply to any 39 Refunding Certificates that are to be executed and delivered for the purpose refund ng all Certificates 40 Outstanding hereunder.
