I ~ <br />,~ <br />1 If any Certificates are not presented for payment at the date fixed for their repayment, or if <br />~2 any Certificates are not presented for payment when due, and if funds sufficient fo such prepayment <br />3 or payment are held by the Trustee, the holders of such Certificates will there fter be restricted <br />4 exclusively to such funds for the satisfaction of any claim relating to such Certific tes. The Trustee <br />5 shall hold such funds (without liability to the holders of the Certificates for interes thereon after the <br />6 prepayment or payment date) and other funds as established hereunder and then u der the Trustee's <br />7 control until required by applicable escheat laws to deliver such moneys in acc rdance with said <br />s escheat laws and thereafter the holders of such Certificates or coupons shall b subject to such <br />9 escheat laws. <br />10 <br />11 SECTION 208. ADDITIONAL CERTIFICATES; OTHER INDEBTEDNESS O COUNTY. <br />12 <br />13 (A) ADDITIONAL CERTIFICATES. Subject only to the conditions, restrictio s and limitations <br />14 set forth in this Section 208, the County reserves the right to direct the Trustee to e ecute and deliver <br />15 Additional Certificates in one or more series for one or more of the following pu oses: <br />16 <br />1 ~ (1) to provide funds sufficient to pay the County's Share o completing the <br />18 Courthouse Square Project in accordance with the original plans and speci ications therefor, <br />19 plus any Costs of Issuance incurred in connection therewith (any Addi 'onal Certificates <br />20 executed and delivered for such purpose being herein called "Completio Certificates"); <br />21 ~ <br />22 (2) to refund all or any portion of the Outstanding Certificates, lus any Costs of <br />~,,3 Issuance incurred in connection therewith (any Additional Certifica es executed and <br />24 delivered for such purpose being herein called "Refunding Certificates")• or <br />25 <br />26 (3) following completion of the Courthouse Square Project in ac ordance with the <br />27 original plans and specifications therefor, to provide funds sufficient to ay the County's <br />28 Share of Improvements to the County Facilities, plus any Costs of Iss ance incurred in <br />29 connection therewith (any Additional Certificates executed and delivere for such purpose <br />3o being herein called "Improvement Certificates"). I <br />31 ~ <br />32 (B) REFUNDING CERTIFICATES. In the event that Refunding Certificates re to be executed <br />33 and delivered to refund less than all Outstanding Certificates, the County may not ~ lirect the issuance <br />34 of such Refunding Certificates, and the Trustee shall not execute and delive such Refunding <br />35 Certificates, unless the aggregate amount of principal and interest scheduled to b due and payable <br />36 with respect to such Refunding Certificates in each Fiscal Year does not exceed by more than $5,000 <br />37 the principal and interest scheduled to be due and payable in the same Fiscal Year 'th respect to the <br />38 Certificates being refunded. The limitation set forth in this Section 208(C) shal not apply to any <br />39 Refunding Certificates that are to be executed and delivered for the purpose refund ng all Certificates <br />40 Outstanding hereunder.
