All terms <br />used herein and not otherwise defined herein shall have the respective meanings ass'gned thereto in <br />the Financing and Trust Agreement dated as of December 1, 1998 between Marion ounty, Oregon <br />(the "County") and the above-named Trustee. I <br />The undersigned does certify that: <br />1. The expenditures for which moneys are requisitioned hereby are to pay the ounty's Share <br />of the Courthouse Square Project and represent proper charges against the Pr ject Fund, have <br />not been included in a previous requisition and have been properly recorded n the County's <br />books. The expenditures for which moneys are hereby requisitioned are set forth in the <br />schedule attached hereto. <br />2. The moneys requisitioned hereby are not greater than those necessary to meet obligations due <br />and payable or to reimburse the County for its funds actually advanced f r the County's <br />Share of the Courthouse Square Project and do not represent a reimburseme to the County <br />for working capital. <br />3. The County is not in default under the Agreement and nothing has occurred t the knowledge <br />of the County that would prevent the performance of its obligations under t e Agreement. <br />5.
