Disposition of Surplus Project Fund Moneys: The moneys remaini g in the Project <br />~r~2 Fund in excess of the totals set forth in 3(a) and (b) above represent surplus bond oceeds and the <br />3 Trustee is hereby authorized and directed to transfer such moneys to the 1998 Debt ervice Account <br />4 to be applied in accordance with the requirements of Section 402(B) of the Agree~ent. <br />5 <br />6 4. No Default: The County is not in default under the Agreement and noth'ng has occurred <br />7 to the knowledge of the County that would prevent the performance of its oblig I tions under the <br />8 Agreement. ,, <br />9 <br />10 This certificate is given without prejudice to any rights against third parties hich exist at the <br />11 date hereof or which may subsequently come into being.
