Contractors employing apprentices or tramees under approved programs shall maintain written evidence of the registration of apprenticeship programs and certification of trainee programs, the ~egistration of the apprentices and trainees, and the ratios and wage rates prescribed in the applicable programs. Section 107 (OSHA): Contract Work Hours and Safety Standards Act - The Contractor agrees to comply with section 107 of the Contract Work Hours and Safety Standards Act, 40 U.S.C. section 333, and applicable DOL regulations, "Safety and Health Regulations for Construction" 29 C.F.R. Part 1926. Among other things, the Contractor agrees that it will not require any laborer or mechanic to work in unsanitazy, hazardous, or dangerous surroundings or working conditions. Clean Air - The Contractor agrees to comply with all applicable standards, orders or regulations issued pursuant to the Clean Air Act, as amended, 42 U.S.C. §§ 7401 et ,se~ . The Cont~actor agrees to report each violation to the Recipient and understands and agrees that the Recipient will; in turn, report each violation as required to assure notification to FI'A and the appropriate EPA Regional Office. Clean Water - The Contractor agrees to comply with all applicable standards, orders or regulations issued pursuant to the Federal Water Pollution Control Act, as amended, 33 U.S.C. 1251 et seg . The Contractor agrees to report each violation to the Recipient and understands and agrees that the Recipient will, in tum, report each violation as required to assure notification to FTA and the appropriate EPA Regional Office. 1 yBy slgning and submitting this Contract, the Contractor is providing the signed certi~cation set out below . 2. The certification in this clause is a material representation of fact upon which reliance was placed when this transaction was entered into. If i[ is later dete[mined that the Contractor knowingly rendeced an erroneous certification, in addition to other remedies available to the Federal Government, Recipient may pursue available remedies, including suspension and/or debarment. 3. The Contractor shall provide immediate written notice to Recipient if at any time the Contractor learns that its certification was erroneous when submitted or has become eaoneous by reason of changed circumstances. 4. The terms "covered transaction," "debarred," "suspended," "ineligible," "lower tier covered transaction," "participant," "persons," "lower tier covered transaction," "principal," "proposal," and "voluntarily excluded," as used in this clause, have the meanings set out in the Definitions and Coverage sections of rules implementing Executive Order 12549 [49 CPR Part 29]. The Contractor agrees by submitting this proposal or entering into this Contract that, should the proposed covered tcansaction be ente~ed into, it shall not knowingly enter inro any lower tier covered transaction with a pe~son who is debarred, suspended, declared ineligible, or voluntarily excluded from participation in this covered transaction, unless authorized in writing by Recipient. 6. The Contractor further agrees by submitting this proposal or entering into this Contract that it will include [he clauses 10 and 11, below, without modification, in all lower tier covered t[ansactions and in all solicitations for lower tier covered transactions.
