<br />a Corporation duly authorized to do general Surery business in Oregon, as Surety, are jointly and severally held and
<br />bound unto Marion Counry, a Political Subdivision of ttie State of Oregon, the Obligeeherein, in the sum ofFIVE HUNDRED
<br />EIGHTEEN THOUSAND FZVE HUNDRED SEV~~[~~S~INE S 18 , 579 . 00 ), for the payment of which we
<br />jointly and severally bind ourselves, our heirs, executors, administrators, successors and assigns, firmly by these
<br />presents: THE CONDITION OF THIS BOND IS SUCH TF~AT, WHEREAS, (Contractor)STATON CONSTRUCTION, INC .
<br />, the Principal herein, on t~ie 21ST~y of APRIL , 19 97, entered into a
<br />Contract with Marion Counry, a Political Subdivision of the State of Oregon, which concract together wi[h the
<br />Drawings, Pfans, Specificaeions, and General Provisions are attached hereto and by this reference made a parc hereof
<br />as if set forth in full herein.
<br />NOW THEREFORE, if the Principal herein shall faithfully and truly observe and comply with the terms, conditions
<br />and provisions of the said Contract, in all respects, and shall welf and truly and fully do and perform all matters and
<br />things by him undertalcen to be performed under said Contrac[, upon the terms set forth therein, and within the time
<br />prescribed therein, or extended as provided in the applicable Plans and SpecificaUons, and shall indemnify and save
<br />harmless Marion County Board of Commissioners, its officers, officials, employees and agents against any direct or
<br />indirect damages of every kind and description that shall be suffered or claimed to be suffered in connection with or
<br />arising out of the perfocmance of the said Contract by the said Contractor or his Subcontractors; and shall make
<br />payment promptly, as due, to all Subcontractors and to all persons supplying to the Contractor or his Subcontrac[ors,
<br />equipment, supplies, labor or materials for the prosecution of the work, or any part thereof; shall pay no (ess than the
<br />prevailing wage rate, as of the date of bid, as set forth in ORS 279.348 through 279.356, provided for in said
<br />Contract, and shall pay al( contributions or amouncs due the S[ate Industrial Accident Fund and the State
<br />Unemployment Trust Fund from such Contractor or Subcontractors incurred in the performance of said Contract, pay
<br />all sums of money withheld from the Contracior's employees and payable to the Revenue Deparcmenr, and shall pay
<br />all other just debts, dues, and demands incurred in the performance of the said Con[rac[ and shall pay Marion County
<br />such damages as may accrue to Marion County under said Contract and shall in all respects perform said Contract
<br />according to law, then this obligation is [o be void, otherwise to remain in full force and effect. Nonpayment of the
<br />Bond premium will not invalidate this Bond, nor shall Marion County be obliga[ed for the payment thereof.
<br />This Bond is given and received under the authority of ORS Chapter 279, the provisions of which hereby are
<br />incorporated into this Bond and made a part hereof.
