MOU.doc <br />1. Operational Partner - A Pilot Project where construction is substantially complete, the <br />building is occupied and operations are active. Investigation is focused on what rating the <br />project would score and correlating the efforts required to achieve that rating. <br />2. Design Partner - A Pilot Proj ect where the facility is still in the design phase. Investigation <br />is focused on usability and im;,? ~mentation of the LEEDTM tool suite. <br />Pilot Program. The U. S. Green Buildi~g Council's 1999 program to evaluate of the LEED <br />Green Building Rating SystemTM. <br />Pilot Project. The capital project that the Partner has nominated to participate in the Pilot <br />Program. All commercial buildings as defined by standard building codes are eligible for <br />nomination, including offices, retail and service establishments, institutional buildings, hotels, and <br />residential buildings of four or more habitable stories. <br />Program Liaison. The Program Liaison has been hired by USGBC to provide oversight <br />coordination and technical support for ihe Pilot Program. <br />USGBC. The U. S. Green Building Council, a 501(c)(6) tax exempt organization dedicated to <br />promoting the understanding, dcvelopment, and accelerated implementation of "Green Building" <br />policies, programs, technologies, standards, and design practices <br />VI. Termination ~f Agreement <br />Each party to this agreement agrees to assume the good faith of the other party as a general <br />principle for the Program. Each party agrees to notify the other if any problems arise and to work <br />together to foster maximum public confidence in the Program. Either party can terminate this <br />agreement, without penalty, via 10 days' written notice to the other, and both will then cease to <br />publicize the Partner's participation in the Program. Reasons for termination include the failure to <br />meet the responsibilities set forth in Sections II through N of this MOU, <br />8 <br />
