f - (E) Any other agricultural, forestry or horticultural use or animal husbandry, or any combination thereof, including the preparation and storage of the produce raised on such farm for human use and animal use, the preparation and storage of forest products and disposal by marketing or otherwise, of farm produce or forest products. ORS 455.315(2)(a) AGRICULTURAL BUILDING does not include: (A) A dwelling; (B) A structure used for a purpose other than growing plants in which 10 or more persons are present at any one time; (C)A structure regulated by the state fire marshal pursuant to ORS Chapter 476; (D) A structure used by the public; or (E) A structure subject to sections 4001 to 4127, Title 42. United States Code (the National Flood Insurance Act of 1968) as amended. And regulations promulgated thereunder. AN EQUINE FACILITY means a building located on a farm; and used by the farm owner or public for stabling or training equines; or riding lessons and training clinics. AN EQUINE FACILITY DOES NOT INCLUDE: (A)A dwelling; (B)A structure in which more than 10 persons are present at anyone time; (C)A structure regulated by the State Fire Marshal pursuant to ORS chapter 476; or (D)A structure subject to section 4001 to 4127, title 42, United States Code( the National Flood Insurance Act of 1968) as amended, and regulation promulgated there under. This exemption from a building permit requirement is for the building permit only. The exemption status for this building does not apply to any other permit requirements. Electrical, plumbing, mechanical and on-site/septic permit requirements are still applicable. No recreational vehicles for personal use or other personal use of the building may be done at any time. EQUIPOTENTIAL PLANES AND BONDING OF EQUIPOTENTIAL PLANES. Equipotential planes shall be installed in concrete slabs where metallic equipment is located that may become energized and accessible to livestock. Marion County may inspect this structure for use in the future to assure that the building is being used exclusively for farm agricultural uses only. If it is found that the building is used for any other use in the future, a building permit will be required at that time.
